Weston, Inc. <br /> 1350 Treat Boulevard <br /> Suite 200 <br /> Walnut Creek,CA 94596-2150 <br /> d <br /> STORMWATER MANAGEMENT - SCOTTS FACILITY IN LINDEN, CALIFORNIA , <br /> m� SAN JOAQUIN COUNTY <br /> We have reviewed your 17 August 1993 letter requesting exemption from having to submit a report of waste <br /> discharge for Scotts proposed green waste composting facility at Linden,CA. <br /> r <br /> Based on the information you have submitted; it appears the proposedgreen-waste composting facility <br /> operations, as you have described them, should not produce a significant amount of pollutants which could <br /> adversely affect the quality of waters of the state. Therefore, waste discharge requirements for the <br /> composting operations are not necessary for this facility, d you are not required to file a report of waste <br /> discharge for the composting operations. <br /> However, with the new stormwater regulations published by the U.S. Environmental Protection Agency on <br /> 16 November 1990(40 CFR Parts 122, 123, and 124)composting facilities are required to obtain an NF DES <br /> permit for stormwater runoff. Also, because the site is greater than 5 acres a construction storm water pernut <br /> will be required when the site is being graded and berms are being constructed. Therefore, if Scotts has not <br /> already done so, they should get coverage under the Construction and General Industrial Stormwater Permits <br /> issued by the State Water Resources Control Board by submitting Notices of Intent as described in the <br /> Construction and Amended General Industrial Storrawater Permit packages.
