I AUTHORITY TO ENTER STIPULATION 2 12, Each signatory to this Stipulation certifies that he or she is fully authorized by the Party he 3 or she represents to enter into this Stipulation,to execute it on behalf of the Party represented, to 4 legally bind that Party and to request entry of the Final Judgment consistent with the provisions of 5 this Stipulation. This Stipulation may be executed by the Parties in counterparts, and when a b copy is signed by an authorized representative of each Party, the Stipulation shall be effective as 7 if a single document were signed by all Parties. g INTEGRATION 9 13. This Stipulation constitutes the entire agreement between the Parties as to the matters 10 addressed herein and shall not be amended or supplemented except upon written order of the 11 Court that enters the Final Judgment in this action. 12 J[TRISDICTION RETAINED 13 14, The Parties submit to the jurisdiction of the Superior Court for the following purposes: 14 (a) entering the Final Judgment in this action; 15 (b) adjudicating any proceeding to enforce this Stipulation and the Final Judgment 16 entered in this action; 17 (c) adjudicating any contempt of the Final Judgment entered in this action; 18 (d) adjudicating any other judicial enforcement proceeding by Plaintiff directed at 19 continuing or additional violations of UST, hazardous waste, and hazardous materials 20 requirements by Defendants under this Stipulation and the Final Judgment entered in this action 21 while the injunctive relief provisions of the Final Judgment are in force; and 22 (e) issuing such further orders as may be necessary and appropriate for the 23 interpretation, implementation, modification and enforcement of this Stipulation and the Final 24 Judgment entered in this action. 25 COSTS AND FEES 26 15. Except as specifically provided herein, each Party agrees that it shall bear its respective 27 costs, expenses and fees, including attorneys' fees, in connection with this action, including, but 28 not limited to, this Stipulation, the Final Judgment and any related actions. 14 Stipulation for Entry of Final Judgment and Permanent Injunction
