SAN J O A Q U I N Environmental Health Department <br /> --COUNTY-- <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> FTG CONSTRUCTION MATERIALS INC 915 ANDERSON ST, STOCKTON October 20,2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: According to the safety assistant,Steve Garcia,oily absorbent generated at the facility is taken <br /> to the main yard located at 5100 W Hwy 12, Lodi, CA 95242 for disposal. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately cease transporting the waste, make a hazardous waste determination for the <br /> oily absorbent,and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test <br /> results or other knowledge to support your hazardous waste determination. Waste testing must be done using <br /> methods specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. <br /> This is a Class II violation. <br /> 608 CCR 66266.130 Failed to properly manage used oil filters or fuel filters. <br /> OBSERVATION: This facility generates drained used metal oil filters. A complete three year bill of lading record for <br /> used oil filter recycling was not observed during the inspection. According to the safety assistant, Steve Garcia, <br /> used oil filters generated at the facility are taken to the main yard located at 5100 W Hwy 12,Lodi, CA 95242 for <br /> disposal. A bill of lading is not generated for the transport of the oil filter. <br /> REGULATION GUIDANCE: <br /> Persons generating,transporting,or receiving used metal oil filters shall use a bill of lading to record the transfer of <br /> used oil filters. Bills of lading must indicate generator,transporter,and receiving company names,addresses, <br /> telephone numbers,the quantity and size of used oil filter containers transferred,and the date of transfer.A copy of <br /> each bill of lading must be kept on the premises of the generator,transporter,and receiving facility where the used <br /> oil filters were handled. Copies of bills of lading shall be kept for a period of three years. <br /> CORRECTIVE ACTION: Immediately begin to leave proper documentation for the transport of the metal oil filters. <br /> Used metal oil filters not stored, handled and disposed of according to this section are regulated as hazardous <br /> waste.
