A business plan shall include <br /> the following emergency response procedures for a release or threatened release of hazardous materials, including, <br /> but not limited to,the following: <br /> - Immediate notification of local emergency personnel and the Environmental Health Department(EHD) <br /> -Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> -Evacuation plans and procedures, including immediate notice,for the site <br /> Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> This is a repeat violation, Class ll. <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br /> A training program has not been submitted annually since 2017. Training programs for all employees and annual <br /> training, including refresher courses, shall include familiarity with the facility's Emergency response plans and <br /> procedures in the event of a release or threatened release of a hazardous material.Training shall cover, but not <br /> limited to, all of the following: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> These training programs may take into consideration of each employee. Immediately prepare or update the facility's <br /> training program, log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> This is a repeat violation, Class ll. <br /> 9 HSC 25508(a)(1) Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br /> System (CERS)annually for 2018, 2019, and 2020, and the business plan was submitted after January 15th for <br /> 2017. The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be <br /> submitted beginning November 1 of the previous year.
