Applicable Greenhouse Gas–Related Laws and Regulations <br />Project Component <br />Applicable Laws/ <br />Regulations Greenhouse Gas Reduction Measures Required for Project <br />Construction <br />Use of Off-Road Diesel <br />Engines, Vehicles, and <br />Equipment <br />CARB In-Use Off- <br />Road Diesel <br />Vehicle <br />Regulation <br />Any relevant vehicle or machine use associated with the Project <br />will be subject to CARB standards. <br />The CARB In-Use-Off-Road Diesel Vehicle Regulation applies to <br />certain off-road diesel engines, vehicles, or equipment greater <br />than 25 horsepower. The regulation imposes limits on idling, <br />requires a written idling policy, and requires a disclosure when <br />selling vehicles; requires all vehicles to be reported to CARB <br />(using the Diesel Off-Road Online Reporting System) and labeled; <br />restricts the adding of older vehicles into fleets starting on <br />January 1, 2014; and requires fleets to reduce their emissions by <br />retiring, replacing, or repowering older engines, or installing <br />Verified Diesel Emission Control Strategies (i.e., exhaust <br />retrofits). <br />The requirements and compliance dates of the Off-Road <br />Regulation vary by fleet size, as defined by the regulation. <br />Cap-and-Trade <br />Program <br />Transportation fuels (e.g., gasoline) used in equipment operation <br />would be subject to the Cap-and-Trade Program (see “Energy <br />Use,” below). <br />Greening New <br />Construction <br />CALGreen Code All new construction, including the Project, must comply with <br />CALGreen, as discussed in more detail throughout this table. <br />Adoption of the mandatory CALGreen standards for construction <br />has been essential for improving the overall environmental <br />performance of new buildings; it also sets voluntary targets for <br />builders to exceed the mandatory requirements. <br />Construction Waste CALGreen Code The Project would be subject to CALGreen requirements for <br />construction waste reduction, disposal, and recycling, such as a <br />requirement to recycle and/or salvage for reuse a minimum of <br />50% of the non-hazardous construction waste in accordance with <br />Section 5.408.1.1, 5.408.1.2, or 5.408.1.3, or meet a local <br />construction and demolition waste management ordinance, <br />whichever is more stringent. <br />Worker, vendor and <br />truck vehicle trips (on- <br />road vehicles) <br />Cap-and-Trade <br />Program <br />Transportation fuels (e.g., gasoline) used in worker, vendor, and <br />truck vehicle trips would be subject to the Cap-and-Trade <br />Program. <br />Solid Waste <br />Solid Waste <br />Management <br />Landfill Methane <br />Control Measure <br />Waste associated with the Project would be disposed of per state <br />requirements for landfills, material recovery facilities, and <br />transfer stations. Per the statewide GHG emissions inventory, the <br />largest emissions from waste management sectors come from <br />landfills and are in the form of methane (CH4). <br />In 2010, CARB adopted a regulation that reduces emissions from <br />CH4 in landfills, primarily by requiring owners and operators of <br />certain uncontrolled municipal solid waste landfills to install gas <br />collection and control systems, and requires existing and newly <br />installed gas and control systems to operate in an optimal
