Mitigation Measure(s) <br />Level of Significance <br />After Mitigation <br />To the maximum extent practicable, construction activities shall <br />be limited to the time between dawn and dusk to avoid the <br />illumination of adjacent habitat areas. If construction activity time <br />restrictions are not possible, down-shielding or directional lighting <br />shall be used to avoid light trespass into bird habitat (i.e., use a <br />“Cobra”-style light rather than an omnidirectional light system to <br />direct light down to the site). To the maximum extent practicable <br />while allowing for public safety, low-intensity energy-saving lighting <br />(e.g. low-pressure sodium lamps) shall be used. Illumination of <br />lighting on associated construction and operation structures shall <br />be minimized by using motion sensors or heat sensors. <br />MM-BIO-3: Avoid and Minimize Unintentional Wildlife Entrapment. <br />Measures identified in the Incidental Take Minimization Measures <br />document (SJCOG 2020) shall be implemented to avoid and <br />minimize impacts related to wildlife entrapment in Project <br />equipment and materials, and to prevent birds from perching or <br />nesting on the Project site where they would be unsafe or <br />vulnerable to potential disturbance, as follows: <br />• Prior to the nesting bird season, anti-perching devices shall be <br />installed on equipment or structures within the Project site <br />that present a suitable place for birds to nest or perch. <br />Alternatively, access to potentially suitable nesting surfaces <br />shall be enclosed with mesh netting, chicken wire fencing, or <br />other suitable exclusion material or otherwise prevented until <br />construction activities are complete or until the structure is <br />removed. <br />• During the time that the birds are trying to build or occupy <br />their nests (generally, April through August, depending on the <br />geographic location), potential nesting surfaces shall be <br />monitored at least once every 3 days for any nesting activity, <br />especially where bird use of structures is likely to cause take. <br />It is permissible to remove non-active nests (without birds or <br />eggs), partially completed nests, or new nests as they are built
