FINDINGS FOR VARIANCE <br /> PA-2000191 <br /> LINDEN COUNTY WATER DISTRICT / LARRY WHITE - WEBER, GHIO & ASSOCIATES <br /> Finding 1 : Special Circumstances <br /> Because of the special circumstances applicable to the property, including size , shape , topography, <br /> location , or surroundings , the strict application of the regulation deprives the property of privileges enjoyed <br /> by other property in the vicinity and under identical zoning classification . <br /> • This finding can be made because the strict application of the regulation does deprive the <br /> property of privileges enjoyed by other properties in the vicinity under the same zoning <br /> classification . The Linden County Water District parcel is 0 . 5 acres in size compared to other <br /> similarly zoned parcels in the vicinity which are much larger . The Linden County Water District <br /> operates pursuant to state regulations which may require upgrades to the facility without regard <br /> to parcel size . Currently, the water district needs to install on the site a 500 , 000 -gallon above- <br /> ground water tank and a 480 -square400t structure to house a new booster pump . To incorporate <br /> all the required equipment and structures on the 0 . 5-acre site , a front yard setback reduction is <br /> necessary. <br /> Findinq 2 : No Special Privileges <br /> The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations <br /> upon other properties in the vicinity and zone in which the property is situated . <br /> • This finding can be made because the granting of this Variance will not constitute a grant of <br /> special privileges . The request is consistent with other properties in the vicinity with the P- F <br /> ( Public Facilities ) zoning . The placement of the proposed office takes advantage of the greater <br /> depth of the property provided by the angle of the street side (south ) property line . This allows <br /> the majority of the expansion to be within the minimum setback . The variance is necessary for <br /> just a small portion of the proposed expansion . <br /> Finding 3 : Use Authorized <br /> The Variance will not authorize a use or activity, which is not otherwise expressly authorized by the regulation <br /> governing the parcel of property . <br /> • This finding can be made because the Variance application does not authorize a use that is not <br /> otherwise expressly authorized by the General Plan or Development Title .
