FINDINGS FOR VARIANCE
PA-2000191
LINDEN COUNTY WATER DISTRICT / LARRY WHITE - WEBER, GHIO & ASSOCIATES
Finding 1 : Special Circumstances
Because of the special circumstances applicable to the property, including size , shape , topography,
location , or surroundings , the strict application of the regulation deprives the property of privileges enjoyed
by other property in the vicinity and under identical zoning classification .
• This finding can be made because the strict application of the regulation does deprive the
property of privileges enjoyed by other properties in the vicinity under the same zoning
classification . The Linden County Water District parcel is 0 . 5 acres in size compared to other
similarly zoned parcels in the vicinity which are much larger . The Linden County Water District
operates pursuant to state regulations which may require upgrades to the facility without regard
to parcel size . Currently, the water district needs to install on the site a 500 , 000 -gallon above-
ground water tank and a 480 -square400t structure to house a new booster pump . To incorporate
all the required equipment and structures on the 0 . 5-acre site , a front yard setback reduction is
necessary.
Findinq 2 : No Special Privileges
The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations
upon other properties in the vicinity and zone in which the property is situated .
• This finding can be made because the granting of this Variance will not constitute a grant of
special privileges . The request is consistent with other properties in the vicinity with the P- F
( Public Facilities ) zoning . The placement of the proposed office takes advantage of the greater
depth of the property provided by the angle of the street side (south ) property line . This allows
the majority of the expansion to be within the minimum setback . The variance is necessary for
just a small portion of the proposed expansion .
Finding 3 : Use Authorized
The Variance will not authorize a use or activity, which is not otherwise expressly authorized by the regulation
governing the parcel of property .
• This finding can be made because the Variance application does not authorize a use that is not
otherwise expressly authorized by the General Plan or Development Title . If the Variance
application is approved , the applicant must apply for the applicable building permits for any
improvements .
PA-2000191 — Findings 1
