June 9, 2003 To: Supervisor Leroy Ornellas, 5th District Board of Supervisors lz�From: Donna Heran, Director I , Environmental Health Department Subject: Roos Ranches, Inc., 938 Frontage Road,Ripon The Environmental Health Department (EHD) has reviewed the letter you received from Jeff Stuit, General Manager of Roos Ranches, Inc., a machine hire company in the almond industry. Mr. Stuit inquired if he would be required to obtain a Collector's License for renting out his dumpster bins for construction, demolition, greenhouse facility and general clean up demands from the ag community, since he is only a small company and averages 200 loads a year. He also asked why County ordinance requires an audited financial statement to accompany a Collector's License application. San Joaquin County Ordinance Code, Chapter 2, Section 5-2202, specifies that the collection and transportation of commercial and industrial solid waste shall be open to competition and subject to obtaining a County business license and County commercial and industrial solid waste collection license, through application with the Department of Public Works. The exemption provisions outlined in the Ordinance Code, Chapter 3, Section 5-2300, do not apply to this business operation since it collects and transports solid waste beyond what is authorized in the exemption section (building construction and demolition waste only). Additionally, this section has no exemption provision based on the size of the business or number of loads hauled per year. The County requirement for submittal of an audited financial statement with the Collector's License application is to assure that the business is financially viable and has a stable operating history before it's considered by the County for issuance of a license. The attached chronology prepared by Robert McClellon, Supervising RENS, further describes the EHD activities associated with this business.
