OBSERVATION: The designated operator employee training for Abraham Muhammad was not performed and he was the only employee on site at the start of the inspection. REGULATION GUIDANCE: The designated operator shall train facility employees in the proper operation and maintenance of the UST system at least once every 12 months. The training shall be conducted before the individual performs the duties of a facility employees.The training shall include, but is not limited to: 1. Operation of the UST system in a manner consistent with the facility's best management practices 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan 3. Employee's role with regard to spills and overfills as specified in the facility's response plan 4. Name of the contact person(s)for emergencies and monitoring equipment alarms Initial training shall also include a site-specific practical demonstration that provides both sharing information and evaluating knowledge for responding to emergencies, leak detection, monitoring alarms, spills and overfills. At least one of the facility employees present during operating hours shall have current training. CORRECTIVE ACTION: Ensure that employees have been trained by the designated operator, maintain the list on site, and submit a copy of the training records to the EHD. This is a Class II violation. 214 CCR 2712 Failure to comply with UST operating permit conditions. OBSERVATION: Per Ahmed Muthanna, he has been the new tank operator for approximately 11 months. A permit transfer has not been completed with the EHD and all required elements have not been submitted to CERS within 30 days of the tank operator change. REGULATION GUIDANCE: Permits may be transferred to new underground storage tank owners if: 1)the new UST owner does not change conditions of the permit; and 2)the transfer is reported to the local agency by submitting all of the required submittal elements in CERS within 30 days of the change in ownership CORRECTIVE ACTION: Immediately take all necessary actions to bring these UST systems into compliance. This is a Class II violation. 319 CCR 2635, 2637.2,2665, 2712 Failure to comply with the installation, inspection, or record keeping of the overfill prevention. OBSERVATION: Overfill prevention testing has not been conducted. REGULATION GUIDANCE: Overfill prevention equipment inspections were required to be conducted by October 13, 2018, and every 36 months thereafter, and within 30 days of completion of a repair. CORRECTIVE ACTION: Immediately schedule this testing and provide 48 hours notification to the EHD. Ensure all future testing is conducted within required time frames. This is a Class II violation.
