The following is an itemized list of hazardous waste violations that have not been <br /> addressed for Big Lots Lodi 4106 as of October 09, 2020. <br /> Open violations from July 15, 2019 inspection <br /> Violation#102-Failed to determine if a waste is a hazardous waste. <br /> Spillage of Comet Bleach Powder was found on the sales shelf containing several containers of Comet Bleach <br /> Powder, one of which was damaged and leaking. (see photos IMG 7287-90) <br /> Any person who generates a waste shall determine if the waste is a hazardous waste. <br /> Immediately clean up the Comet Bleach Powder spillage, make a hazardous waste determination for the leaking <br /> container and clean-up material, and manage them according the Title 22 hazardous waste regulations. <br /> Submit a statement and supporting documentation explaining how this waste was managed. <br /> EX This violation was corrected EXThis violation will be corrected by(date): 08/01/2019 <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: COMET BLEACH POWDER WAS CLEANED AND <br /> DAMAGED PRODUCT WAS DISPOSED OF VIA OUR 3RD PARTY HAZARDOUS WASTE <br /> CARRIER AS CORROSIVE BASE HAZARDOUS WASTE. <br /> Violation#103-Failed to retain hazardous waste determination including waste analysis on site for 3 years. <br /> Connie San Martin,Assistant Store Manager, stated that items are scanned and placed in the HW tote indicated by <br /> the facility's (phone scanning application, however the application was not working at the time of inspection. Connie <br /> stated that when the HW determination is not available on the (phone application, the item's label,the Big Lots <br /> Waste Disposal Quick Reference Guide, and information on the HW tote labels are used to make a HW <br /> determination for an item. <br /> -A solid air freshener was found bagged and in the Toxic&State(TX&ST)hazardous waste(HW)tote. Connie did <br /> not know how the air freshener was determined to be placed in the TX&ST HW tote, as opposed to a tote with <br /> another HW classification (e.g. Flammable/Compressed Gas, Oxidizer, Corrosive Acid, and Corrosive Base), based <br /> on the item's label,the Big Lots Waste Disposal Quick Reference Guide, and the information on the HW tote labels. <br /> -A Lexmark 246035 Toner Cartridge was found bagged and in the TX&ST HW tote. When asked how it was <br /> determined that the toner cartridge should be placed in the TX&ST HW tote, Connie stated that she just knew that <br /> the toner cartridge belonged in that tote. <br /> A generator shall make a hazardous waste determination and keep a record of any test results,waste analyses, or <br /> other determinations made in accordance with hazardous waste regulations for at least three years from the date <br /> that the waste was last disposed of. <br /> Immediately locate a copy of the hazardous waste determination made for the hazardous waste items listed above, <br /> ensure store employees are familiar with these waste determinations, and submit a copy to the EHD. <br /> If a copy is unavailable, immediately make a hazardous waste determination and begin managing the above listed <br /> waste under Title 22 hazardous waste regulations. <br /> This is a Class II violation. <br /> Page 1 of 2 <br />
