J� AGRi:Ei'4E.NT <br /> THIS AGREEMENT , made and entered into this day <br /> of _ �,f, 197 by and between the CITY OF STOCKTON, a <br /> municipal corporation of the State 'of California , hereinafter <br /> referred to as "CITY" , and the COUNTY OF SAN JOAQUIN, a political <br /> subdivision of the State of California, hereinafter referred to <br /> as "COUNTY" , is for the use by County of the City' s Regional <br /> Wastewater Control Facilities and System. <br /> RECITALS <br /> This Agreement is predicated on the following 'facts : <br /> A. Increases in population in the City of Stockton and <br /> changes in requirements for wastewater treatment and disposal, <br /> have created an urgent need for additional facilities for the . <br /> transmission, treatment and disposal of wastewater. <br /> B. To protect the health and' safety of its citizens , to <br /> preserve and enhance their environment , and to provide for future <br /> growth population in the metropolitan/regional area of Stockton , <br /> i <br /> the City intends to acquire , construct and expand facilities for <br /> r <br /> the transmission , treatment and the disposal of wastewater and <br /> the disposal of the byproducts of. wasteivater treatment. <br /> C. A special condition of wasteraater''tertiary treatment ; <br /> project certification for award of Federal. and State grants to <br /> the City requires that City "shall provide regional treatment <br /> capacity in the proposed facilities and furnish services to <br /> area dischargers of wastewater based on fair and equitable con- <br /> ditions ." <br /> D.
