r <br /> SOUTHERN WATER SYSTEM OPERATION & MAINTENANCE AGREEMENT <br /> THIS AGREEMENT, is made anal entered into this 8th day of <br /> JUNE , 1989, by and between the CITY OF STOCKTON, a <br /> municipal corporation of the State of California, hereinafter <br /> referred to as "CITY", and the COUNTY OF SAN JOAQUIN, a political <br /> subdivision of the State of California, 'governed by the Board of <br /> Supervisors of San Joaquin, hereinafter referred to as "COUNTY" . <br /> WITNESSETH: <br /> WHEREAS, on November 17 , 1986, CITY adopted the South <br /> Stockton Water Master Plan, sometimes hereinafter referred to as <br /> "PLAN", calling for a- conjunctive grater management program that <br /> would service an area, as shown in Figure -1-1 of the South <br /> Stockton Water Master Plan, comprised generally as follows: <br /> Lands south of those urban areas now served by the California <br /> Water Service Company, north of Roth Road, and a line extending <br /> easterly of Highway 99 approximately 3, 500 feet and bounded on <br /> the west by Wolfe Road, and additional areas deemed appropriate <br /> to be served; and <br /> WHEREAS, CITY and COUNTY have agreed to consolidate the CITY <br /> and COUNTY water systems to provide for CITY operation and main- <br /> tenance of the CITY' s Air Park and COUNTY' s Southern Water System <br /> as one composite system; and <br /> WHEREAS, it is necessary to enter into this agreement spe- <br /> cifying the respective 4uties and obligations of CITY and COUNTY <br /> necessary for the consolidation of the CITY and COUNTY grater <br /> systems. <br /> NOW, THEREFORE, it is hereby agreed by and between the par- <br /> ties hereto as follows: <br /> 1 . PURPOSE OF AGREEMENT. The purpose and intent of this <br /> agreement is to authorize CI`T'Y to be the agency to administer , <br /> operate, maintain, and expand all of CITY and COUNTY water <br /> supply, storage, and transmission facilities in the area within <br /> the South Stockton Master 'dater flan, more particularly described <br /> in Exhibit "A", attached hereto and made a part hereof, including <br /> the COUNTY' s water- supply and distribution system as shown more - <br /> particularly in Exhibit "B" attached hereto and made a part <br /> hereof . The CITY will be responsible for maintaining all the <br /> existing COUNTY facilities up to and including the water meters . <br /> - 1 -- <br />
