4 Master Water Plan adopted by CITY on November 17, 1986, <br /> (Resolution No. 86--0702) , expressly incorporated by reference as <br /> part of this agreement, shall provide the general guidelines for <br /> planning and development of water supply sources and transmission <br /> facilities subject to such modifications as may be necessary to <br /> meet future conditions and growth within the service area. <br /> 6. CONSTRUCTION OF TRANSMISSION LINE TO STOCKTON EAST WATER <br /> DISTRICT SEWD . CITY shall develop plans and specifications for <br /> the South Stockton Aqueduct to connect to the SEWD Plant in <br /> accordance with the PLAN. Within two (2) years of execution of <br /> this agreement, COUNTY may request that CITY oversize the South <br /> Stockton Aqueduct and extend it such that it will provide ser- <br /> vices for the Lathrop-Manteca areas. Contract(s) for the <br /> construction of the transmission line shall be awarded within <br /> three (3) years of COUNTY notification as to the oversizing and <br /> extension of the South Stockton Aqueduct . <br /> 7. COVENANT OF COOPERATION. The parties to this agreement <br /> do hereby covenants to complete all actions necessary to comply <br /> with the provisions of this agreement. <br /> B. CITY TO ADMINISTER CONSTRUCTION PROJECTS. CITY shall <br /> fund and administer this agreement and shall do all acts reaso- <br /> nably necessary to the proper execution for the maximum public <br /> benefit and the common purpose of this ae�reement. CITY shall <br /> design, call for bids, make award of contract and administer the <br /> construction projects as provided in paragraphs 3 and 6 of this <br /> agreement . <br /> 9. OWNERSHIP OF FACILITIES. <br /> A. COUNTY hereby grants Lo CITY the following irrevocable <br /> rights: <br /> 1 . To use, for transmission of CITY water, all of <br /> COUNTY's off-site facilities located within the area covered by <br /> PLAN as shown in Exhibit "D" , incorporated by reference herein. <br /> 2 . To provide service to new customers from the COUNTY' s <br /> off-site facilities , as shown in Exhibit "D" ; and <br /> 3 . To expand and/or extend COUNTY-owned lines which are <br /> shown in Exhibit "D" , as deemed necessary to CITY to fulfill its <br /> obligation under this agreement and/or to provide service to new <br /> areas. <br /> B. All facilities constructed by CITY pursuant to this <br /> agreement shall be owned by CITY. Notwithstanding the irrevo- <br /> cable right granted in this clause the COUNTY shall retain <br /> ownership of the facilities shown in Exhibit "D" . <br /> 3 - <br />
