In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />A Spill Container testing conducted on 05/27/2020 marked the 91 product direct bury <br />spill container as fail. <br />On 05/06/2021 Paul Nso, of San Joaquin County Environmental Health Depart <br />ment (EHD) conducted an official routine <br />inspection and issued violation #318 at the above site. <br />On June 03, 2021 we issued a seven business days notice to correct the violation. <br />As of this date a repair permit has not been obtained to address this issue. This site continues to be out of compliance for <br />the following: <br />Failures to comply with spill container requirements (CCR 2635, 2637.1). <br />No person shall remove, deface, alter or otherwise temper with a red tag so that the information contained on the tag is <br />not legible. No owner/operator of a facility may deposit or allow the deposit of petroleum into and no person shall withdr <br />from, except to empty, a UST system that has a red tag affixed to the system's fill pipe.
