<br />PA-1900284 – Findings 1 <br />FINDINGS FOR SITE APPROVAL <br />PA-1900284 <br />MUHAMMAD BILAL <br /> <br />1. The proposed use is consistent with the General Plan, any applicable Master Plan, Specific Plan, and <br />Special Purpose Plan and any other applicable plan adopted by the County. <br /> <br /> This finding can be made because the Gasoline Sales and Service - Combination and Eating <br />Establishment - Convenience use types are consistent with the General Plan’s General <br />Commercial (C/G) designation, and in turn may, be conditionally permitted with a Site <br />Approval application in the General Commercial (C-G) zone. The proposed gasoline station <br />and restaurant are consistent with the goals, policies, standards, and maps of the General <br />Plan, and there are no Master Plans or Special Purpose Plan applicable to this site. <br /> <br />2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br />facilities have been provided, and the proposed improvements are properly related to existing and <br />proposed roadways. <br /> <br /> This finding can be made because the necessary facilities and improvements are existing <br />or proposed. The applicant has supplied will-serve letters from the City of Stockton for <br />public sanitary sewer service, the California Water Company for public water supply, and <br />East Stockton Storm for storm drainage. As a Condition of Approval, the applicant must <br />comply with the Underground Storage Tank Program through the Environmental Health <br />Department for the proposed underground storage tanks. Additionally, as a condition of <br />approval, the Community Development Department will require a minimum 10 foot <br />landscaped strip respecting the ultimate right-of-way of East Fremont Street and North Oro <br />Avenue. As a result, the project will improve the aesthetics of the general vicinity. <br /> <br />3. The site is physically suitable for the type of development and for the intensity of development. <br /> <br /> This finding can be made because the 0.69-acre parcel is of adequate size and shape to <br />accommodate the proposed fuel station and convenience store and all necessary <br />improvements. The access driveways meet the 25 foot minimum requirement for two-way <br />access, and the site plan shows that there is sufficient area for parking and circulation, in <br />compliance with standards of the Development Title. In addition, a Traffic Impact Analysis <br />completed by KD Anderson on September 23, 2020, found that there were no traffic issues <br />as a result of the project, as long as project traffic accessing the site directly from State <br />Route 26 was limited to right in/right out movements. The Department of Public Works has <br />incorporated this recommendation into their recommended Conditions of Approval, and is <br />requiring signage and a channelized raised median island. These measures will ensure the <br />project will not create a traffic operational issue. <br /> <br />4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be <br />injurious to the property or improvements of adjacent properties. <br /> <br /> This finding can be made because the Initial Study prepared for the project found no <br />potentially significant environmental impacts that could not be mitigated to a less than <br />significant level. As noted above, a Traffic Impact Analysis was completed for the project, and <br />the Department of Public Works has incorporated recommendations from the report into their <br />recommended conditions of approval, so that there will not be traffic operational issues <br />associated with project traffic. The applicant has also chosen to participate in San Joaquin <br />Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) through the San Joaquin <br />Council of Governments. <br /> <br />
