Notice and Order 01-07 lists violations of Public Resources Code §44002,
"No person shall operate a solid waste facility without a solid waste facilities permit ..." and Title 14
California Code of Regulations § 17854, "...all compostable materials handling activities shall obtain a
Compostable Materials Handling Facility Permit ..." SKS Enterprises was required to submit a
correction action plan to the EHD within five days.
On July 12, 2007, SKS Enterprises submitted a corrective action plan to the Environmental Health
Department. The plan stated that the chicken carcasses would be hauled to a local landfill for disposal
within 2.5 weeks and the bunker building would be cleaned. The EHD conducted a site visit on July 31,
2007 and observed that all of the carcasses had been hauled to the landfill and the bunker building was
clean.
SKS Enterprises has satisfied the conditions of Notice and Order 0 1 -07 to cease and desist chicken
carcass composting and to dispose of the carcass waste. In the future, when the chicken houses are
depopulated, the facility plans to hire a contractor to haul chicken carcasses directly to a permitted
landfill.
arrett Backus, REHS
Environmental Health Department
c: David Irey, Supervising Deputy District Attorney
c: Wen Chang Su, General Manager, SKS Enterprises, Inc.
