The following is an itemized list of hazardous waste violations that have not been <br /> addressed for ULLOAS TOW &AUTO REPAIR as of January 21, 2021. <br /> Open violations from January 16, 2020 inspection <br /> OBSERVATION: This facility was inspected on 1/11/2016 and the following minor violations were written: <br /> 1. Managed a hazardous waste without an identification number <br /> 2. No modified contingency plan <br /> 3. Failed to keep copies of consolidated manifesting receipts for three years <br /> 4. Facility not maintained to minimize the release of a hazardous waste <br /> 5. Failed to maintain required emergency equipment <br /> 6. Failed to keep hazardous waste containers closed except when adding or removing hazardous waste <br /> 7. Failed to completely label containers or tanks of hazardous waste <br /> 8. Failed to properly managed used oil and fuel filters <br /> The inspection report was delivered to this facility on 1/11/2016.A complete Return to Compliance Certification form <br /> and written response was not received by the San Joaquin County Environmental Health Department(EHD)within <br /> 30 days of inspection report delivery. <br /> REGULATION GUIDANCE: <br /> (c)(1)A person who receives a notice to comply detailing a minor violation shall have not more than 30 days from <br /> the date of the notice to comply in which to correct any violation cited in the notice to comply.Within five working <br /> days of correcting the violation, the person cited or an authorized representative shall sign the notice to comply, <br /> certifying that any violation has been corrected, and return the notice to the San Joaquin County Environmental <br /> Health Department(EHD). <br /> (e) If a person who receives a notice to comply pursuant to subdivision (a)disagrees with one or more of the <br /> alleged violations listed on the notice to comply,the person shall provide the EHD a written notice of disagreement <br /> along with the returned signed notice to comply. If the person disagrees with all of the alleged violations, the written <br /> notice of disagreement shall be returned in lieu of the signed certification of correction within 30 days of the date of <br /> issuance of the notice to comply. <br /> CORRECTIVE ACTION: Please provide a corrective action statement to the EHD within 30 days. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#101 -Managed a hazardous waste without an identification number. <br /> OBSERVATION: This business does not have an active hazardous waste ID number in the California Department <br /> of Toxic Substances Control (DTSC)database. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of,transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification <br /> (ID) Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than 1 kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to reactivate your State ID number. Immediately reactivate your ID number and submit evidence to the San <br /> Joaquin County Environmental Health Department within 30 days. <br /> Page 1 of 11 <br />
