BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUE4 T 0) 3 1990 <br />STATE OF CALIFORNIA <br />R-90-iI go <br />RESOLUTION PROVIDING FOR THE ESTABLISHMENT OF ADDITIONAL <br />STIPULATIONS FOR THE SOLID WASTE CLOSURE ENTERPRISE FUND, <br />AND FOR THE ADDITION OF THE CORRAL HOLLOW SANITARY <br />LANDFILL SUB -BUDGET UNIT TO THE <br />SOLID WASTE CLOSURE ENTERPRISE FUND <br />WHEREAS, Government Code Section 66796.22 and Sections of <br />Title 14 of the -California Code of Regulations ("Regulations"), <br />Chapter 5, Article 3.5, require operators of solid waste <br />landfills to demonstrate the availability of financial resources <br />to conduct closure and postclosure maintenance activities; and <br />WHEREAS, Sections 18283 and 18285 of the Regulations specify <br />an Enterprise Fund, and related financial assurance mechanisms, <br />as an acceptable mechanism to demonstrate financial <br />responsibility for financing closure and/or postclosure <br />maintenance of a solid waste landfill; and, <br />WHEREAS, on December 6, 1988, the County of San Joaquin <br />Board of Supervisors, to comply with the Regulations, passed and <br />adopted Resolution R-88-1323 which provided for the establishment <br />of the Solid Waste Closure Enterprise Fund (SWCEF); and <br />WHEREAS, on August 22, 1989, the County of San Joaquin Board <br />of Supervisors passed and adopted Resolution R-89-695, which <br />reaffirmed the creation of the SWCEF by incorporating the <br />provisions of Resolution R-88-1323, and placed additional <br />stipulations on the SWCEF; and <br />WHEREAS, the purpose of the SWCEF is to dedicate its revenue <br />exclusively to financing closure and/or postclosure maintenance <br />of the Harney Lane, North County, and Foothill Sanitary <br />Landfills; and <br />WHEREAS, on July 1, 1990, the County of San Joaquin assumed <br />operation of the Corral Hollow Sanitary Landfill, and must comply <br />with the Regulations by establishing a closure and postclosure <br />maintenance fund for the Landfill; <br />WHEREAS, the California Integrated Waste Management Board <br />(CIWMB) has established new requirements which impact the <br />County's SWCEF; and <br />WHEREAS, the County df San Joaquin must comply with the new <br />requirements established by the CIWMB. <br />
