FINDINGS FOR USE PERMIT <br />PA -1800206 <br />ALICE L. KIDD TRUST ET AL. I MARK KIDD <br />1. The proposed use is consistent with the goals, policies, standards, and maps of fihe General Plan, any <br />applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan adopted <br />by the County. <br />• This finding can be made because the commercial stable use type is consistent policies <br />related to the General Plan's General Agriculture (AIG) designation and in turn may be <br />conditionally permitted with a Use Permit application in the General Agriculture, 40 -acre <br />minimum (AG -40) zone. The proposed commercial stable is consistent with the goals, <br />policies, standards, and maps of the General Plan, and there are no Master Plans or Special <br />Purpose Plan applicable to this site. <br />2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br />facilities have been provided, and the proposed improvements are properly related to existing and <br />proposed roadways. <br />• This finding can be made because the necessary facilities and improvements are existing <br />or proposed. The project site is already served by an on-site well and a septic system. The <br />Environmental Health Department is requiring construction of an additional sewage <br />disposal system for the project as a Condition of Approval. Also, as a Condition of Approval, <br />the Department of Public Works is requiring the developer to provide drainage facilities that <br />meet the requirements of San Joaquin County Development Standards for any additional <br />runoff attributed to this project development. <br />3. The site is physically suitable for the type of development and for the intensity of development. <br />• This finding can be made because the project site is over 20 acres and of adequate size and <br />shape to accommodate the proposed use and all yards, building coverage, setbacks, parking <br />areas and other requirements of this Title. <br />4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be <br />injurious to the property or improvements of adjacent properties. <br />• This finding can be made because the Initial Study prepared for the project found no <br />potentially significant environmental impacts that could not be mitigated to a less than a <br />significant level. With the recommended conditions from the Environmental Health <br />Department and the Department of Public Works, the project is expected to have a less than <br />significant impact on public health, safety, and welfare. In addition, the project is not <br />anticipated to be injurious to the property or improvements of adjacent properties. <br />5. The use is compatible with adjoining land uses. <br />• This finding can be made because the proposed use, a commercial stable, will not interfere <br />with nor alter the current land uses on adjacent properties. The adjacent parcels are primarily <br />agricultural with scattered residences and the proposed use may be conditionally permitted <br />in the AG -40 zone subject to an approved Use Permit application. Additionally, the proposed <br />use will not result in the removal of any contracted land on adjacent properties from <br />agricultural or open -space use, or negatively impact adjacent noncontracted lands in an <br />agricultural preserve. <br />PA -1800206 (UP) —Findings 1 <br />
