I regulations set forth in Paragraph 5. The ECM shall also assess the effectiveness of Defendants' 2 compliance with the terms of this Final Judgment and shall author and submit to the persons listed in 3 Exhibit B a written report ("Status Report") that sununarizes the findings of the audit and sets forth 4 any measures taken and/or planned by Defendants in relation to compliance with this Final Judgment. 5 The audit and Status Report shall include a review of inspection reports by any regulatory agency and 6 private contractor(including by any DO)related to any Facility owned and/or operated by Defendants 7 and review of all documents relating to compliance, including but not limited to UST alarm logs, 8 records documenting that all personnel requiring training have in fact been trained, forms 9 documenting inspection of hazardous waste storage areas, and interviews with station employees 10 regarding their understanding of their roles regarding compliance required by this Final Judgment. 11 The Status Report shall disclose any notice of violation that Defendants have received pertaining to 12 the matters covered in this Final Judgment, whether received verbally, in written form in conjunction 13 with a regulatory inspection, in any formal Notice of Violation, or in any other form. The Status 14 Report shall document the cause of the violation, all actions taken by Defendants in response to such 15 violation, and any compliance failures of which Defendants are aware. 16 f. Each Status Report shall include the following as attachments: an updated 17 version of the written compliance plan; all annual monitoring system certifications; secondary 18 containment testing reports; tank inspection reports; monthly Designated UST Operator("DO") 19 inspection reports; and enhanced leak detection reports. Each Status Report shall be signed by the 20 ECM. The certification shall read, "Based on the combination of my personal knowledge and belief 21 formed in reliance on information provided to me and after conducting reasonable inquiry,I declare 22 under penalty of perjury that the information contained in and accompanying this submission is true, 23 accurate, and complete." Each Status Report shall be completed and submitted to Plaintiff within 24 30 days following the above-described 6-month period. 25 CIVIL PENALTIES AND COSTS 26 7_ Upon entry of this Final Judgment, Defendants shall be liable for the total settlement 27 amount of one million one hundred thousand ($1,100,000.00) dollars, as set forth below. All 28 payments made pursuant to this Final Judgment shall be made by check to the payees listed in Exhibits Is Hassan&Sons,Inc.,et al. [Proposed] Final Judgment and Perrnanent Injunction
