SAN 1 O A Q U I N Environmental Health Department <br /> WASTE DISCHARGE/SPILL RESPONSE <br /> NOTICE TO ABATE <br /> Responsible Party: PG&E Date: Feb 13, 2020 <br /> RP Mailing Address: PO BOX 7640 Record ID#: C00051599 <br /> SAN FRANCISCO, CA 94120- Program Element: 2546 <br /> Spill Location: 16644 ST RT 26, LINDEN Release/Spill Response(excluding Joint Team) <br /> NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br /> 40 gallons of mineral oil were released onto asphalt and dirt. <br /> OBSERVATIONS: <br /> Arrived on site after the cleanup had been completed by Dave Larson with PG&E. The street was cleaned using absorbent <br /> and the contaminated soil was removed. Approximately 8 yards of soil waste/absorbent was generated and put into a roll off <br /> bin. The waste is going to be treated as non-hazardous because the test results came back as non-detect for the presence <br /> of PCBs. No storm drains or waterways were observed affected. <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> ° Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> 11 Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> ° Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Submit final disposal records to the EHD. <br /> ° Other Correction <br /> COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br /> rate.
