Oily staining was observed on <br /> the road. The road was cleaned by Caltrans using absorbent. The absorbent was swept onto the side of the road near the <br /> hydraulic oil. Caltrans placed additional absorbent onto the pooled oil to contain it. PG&E is going to cover the <br /> contaminated area with a plastic tarp to prevent furthers read and has planned to clean it on 11/14/2020. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Submit final disposal records to the EHD. <br /> Other Correction <br /> COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br /> rate.
