COMPLIANCE DATE: mIS . f-1, wow UNLAWFUL NOT TO SECURE AFTER NOTICE It is unlawful for any owner, agent, lessee or person having charge or control of any unsecured, unsafe property condition within the unincorporated area of San Joaquin County to refuse or neglect to secure said unsafe condition, hereinbefore declared to be a public nuisance, after notice from the enforcement agency. (San Joaquin County Ordinance Code Section 8-5601) ENFORCEMENT AND COST RECOVERY Pursuant to the San Joaquin County Ordinance Code Section 8-5601, the existence of an unsecured building(s) is a public nuisance. Notice is hereby given that the property mentioned above is hereby declared a public nuisance and dangerous to the health and safety of the inhabitants of said San Joaquin County because the unoccupied house, garage, building, or other structure(s) has unsecured opening into which free entry may be made. The structure(s) must be securely closed by boarding up with materials, which will disallow entry by unauthorized persons, and must be maintained in such condition at all times while unoccupied. (Other methods of securements may be approved by the Environmental Health Department). Failure to secure the building(s) within ten (10) days may cause San Joaquin County to have such boarding up completed. The cost of such securement will be the responsibility of the legal owner. If not paid on the property tax of the affected property. Failure to secure the above mentioned building(s) within (10) days is punishable as a misdemeanor. APPEAL An appeal to seek relief from this order may be field with the Director of the Environmental Health Department The appeal must be in writing, must contain reasons for seeking relief from this order and must be received by the Environmental Health Department prior to the compliance date of this order. The Director or designee shall make a decision on the merit of the appeal within two (2) working days and may sustain, modify, or overturn this order. a decision of the director is final.
