FINDINGS FOR USE PERMIT <br /> PA-2100022 <br /> JATINDER DHILLON/40FORTY, LLC <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the use type Wineries and Wine Cellars —Winery, Small <br /> and Agricultural Processing — Food Manufacturing may be conditionally permitted in the <br /> AG-40 (General Agriculture, 40 acre minimum) zone with an approved Use Permit <br /> application. The project site has a General Plan designation of A/G (General Agriculture), <br /> and the AG-40 zone is an implementing zone for this designation.There are no Master Plans, <br /> Specific Plans, or Special Purpose Plans in the vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because adequate utilities, access roads, sanitation, drainage, <br /> and other necessary facilities have been provided and the proposed improvements are <br /> properly related to existing and proposed streets and highways. The project site will served <br /> by on-site well,wastewater treatment system, and storm drainage constructed under permit <br /> and inspection by the Environmental Health Department and the Department of Public <br /> Works. The amount of storm drainage runoff generated by the construction of any new <br /> buildings will be contained on-site. The Department of Public Works is requiring the <br /> developer to provide drainage facilities and meet the requirements of San Joaquin County <br /> Development Standards to prevent the increased runoff release rate of storm water from <br /> discharging onto other properties and to prevent offsite sediment transport. Wastewater <br /> generated by the winery and brewery production process will be contained on-site in above- <br /> ground holding tanks and hauled off site on an annual bases. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 10-acre project area is of adequate size and shape to <br /> accommodate the proposed uses, as well as yards, building coverage, setbacks, parking <br /> areas and other requirements of the Development Title. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the project has been conditioned to meet San Joaquin <br /> County development regulations that protect public health, safety, and welfare and ensure <br /> the project is not injurious to adjacent properties. <br /> 5. The use is compatible with adjoining land uses. <br /> • This finding can be made because the proposed use is an agricultural use within an <br /> agricultural area. The parcels to the north, south, east, and west are currently used for <br /> agricultural purposes with scattered residential development. The nearest residence is <br /> approximately 460 feet to the west.The project is subject to increased setbacks pursuant to <br /> Development Title 9-1075.5(c) requiring a minimum setback of 100 feet from any property <br /> lines adjacent of a neighboring residence to limit the impacts to surrounding properties. <br /> The proposed winery and brewery compatible with the adjoining land uses. <br /> PA-2100022— Findings 1 <br />
