SAN JOAQUIN <br />COUNTY— <br />Environmental Health Department <br />10/17/2019 <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Facility Name: <br />Facility Address: <br />Date: <br />ULTA BEAUTY #1143 <br />2292 Daniels St, Manteca <br />October 10, 2019 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />405 <br />CCR 66262.34(d)(2) Failed to manage incompatible wastes in containers properly. <br />OBSERVATION: The following incompatible wastes are stored in way that is not in compliance with these <br />sections: <br />The waste listed below was found in a silver hazardous waste container observed in the Ulta Salon and labeled <br />with the words "This trash can is for Salon color tubes only," "Empty Daily," "Hazardous Waste Satellite <br />Accumulation Area," "Oxidizers: Liquids and Solids," and with the generator name and address (IMG 8600-2). <br />- At least twenty almost empty 24 oz bottles of Redken SEQ Gloss of various colors (IMG 8603, 8615). When a <br />bottle of Redken SEQ Gloss 09P (SKU #2295848) was scanned, the hand-held scanner indicated that the waste <br />item was a flammable liquid (IMG 8604-6). <br />According to Brittany Kelm, General Manager, once the Salon employees are done using products, the employees <br />place the used product containers into the silver oxidizers hazardous waste container, since the containers hold <br />residual from the products that were once inside the containers and cannot be thrown into the trash. <br />The silver hazardous waste container also contained at least four used 4 -fl oz bottles of Matrix Socolor Cult <br />semi-permanent hair color, at least three used 2 oz tubes of Redken Cover Fusion low ammonia hair color cream, <br />and at least three used 2 oz tubes of Redken Chromatics zero ammonia permanent hair color cream (IMG <br />8607-8615). According to the Ulta Potentially Hazardous Waste Management poster, found posted on a wall in the <br />hazardous waste storage area, hydrogen peroxide based products including hair color, lightener and tint, are to be <br />placed in a Oxidizer (OX) Hazardous Waste container (IMG 8597). <br />REGULATION GUIDANCE: <br />Incompatible wastes, or incompatible wastes and materials shall not be placed in the same container, unless <br />section 66265.17(b) is complied with. <br />(b) Hazardous waste shall not be placed in an unwashed container that previously held an incompatible waste or <br />material. <br />(c) A container holding a hazardous waste that is incompatible with any waste or other materials transferred or <br />stored nearby in other containers, or open tanks, shall be separated from the other materials or protected from <br />them by means of a dike, berm, wall, or other device. <br />66265.17(b) Where specifically required by other sections of this chapter, the transfer, treatment, storage, or <br />disposal of ignitable or reactive waste, and the mixture or commingling of incompatible wastes, or incompatible <br />wastes and materials, shall be conducted so that it does not: <br />(1) generate extreme heat or pressure, fire or explosion, or violent reaction; <br />(2) produce uncontrolled toxic mists, fumes, dusts, or gases in sufficient quantities to threaten human health or the <br />environment; <br />(3) produce uncontrolled flammable fumes or gases in sufficient quantities to pose a risk of fire or explosions; <br />(4) damage the structural integrity of the device or facility containing the waste; or <br />(5) through other like means threaten human health or the environment. <br />CORRECTIVE ACTION: Immediately make changes to the hazardous waste storage to eliminate incompatible <br />waste storage. Describe how the waste storage has been changed to correct the violation.
