SAKJOAQUIN <br />COUNTY <br />Environmental Health Department <br />10/9/2019 <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Facility Name: <br />Facility Address: <br />Date: <br />ULTA BEAUTY #1152 (Lodi) <br />1423 S LOWER SACRAMENTO RD, Lodi <br />October 07, 2019 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS ll, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />106 <br />CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. <br />OBSERVATION: At the time of inspection, it could not be demonstrated (not necessarily documented) that <br />employees who handle hazardous waste were properly trained, based on the following observations: <br />1. When asked how the facility cleans up a chemical/product spill in the facility, Christine Novoa, Merchandise <br />Service Coordinator, stated employees use Spill Magic (absorbent) to soak up a liquid spill. When asked how the <br />facility manages the absorbent used to clean up a chemical/product spill, Christine stated that she throws the used <br />absorbent into the trash. When asked when the most recent spill and clean-up in the facility occurred, Christine <br />stated a fragrance was spilled and cleaned up about one month ago. According to the Ulta Beauty Retail Stores <br />Hazardous Waste Training Guide (see photo IMG 8536), found posted above the hazardous waste storage area, <br />absorbent used to clean up a spilled chemical/product is to placed in a bag, labeled with the brand and product <br />description, and placed in the In Store Pending Review Damage bin. However, according to Christine, the facility no <br />longer uses the In Store Pending Review Damage bin, since all damaged product is placed in the hazardous waste <br />containers. <br />2. A Flammable Liquid & Flammable Solid (FL) Hazardous Waste container, containing waste fragrances, nail <br />polishes, and flammable cosmetics, was missing the generator's complete address on the hazardous waste label <br />(IMG 8502-3). <br />3. The following waste items were found inside a container labeled as State Managed Waste / Toxic (ST) <br />Hazardous Waste (HW) (IMG 8511-2): <br />- A box containing a Clarisonic Mia Prima Sonic Cleansing Face Brush (IMG 8513). However, when Christine <br />Novoa, Merchandise Service Coordinator, scanned the waste item, the item was identified under the words "Battery <br />Recycling" (IMG 8514). Christine stated the waste item should have been placed in the container designated for <br />batteries, which was found on the floor next to the hazardous waste storage area and labeled as Battery Recycling <br />Kit (IMG 8525-8). Christine stated the battery container was missing the proper label. According to the Ulta <br />Potentially Hazardous Waste Management posters, found posted next to the hazardous waste storage area, waste <br />batteries are to be placed in a container with a Universal Waste label (IMG 8533, 8537). <br />- A box containing a green bottle of Clinique liquid facial soap, a pink bottle of Clinique clarifying lotion, and a yellow <br />bottle of Clinique moisturizing gel (IMG 8516). The box and the pink bottle of Clinique clarifying lotion labeled the <br />clarifying lotion as flammable (IMG 8517-8). When the box was scanned, the hand-held scanner identified the entire <br />box, including the clarifying lotion, as State Managed Waste. Christine stated all three bottles were placed in the ST <br />HW container, based on the information provided by the scanner. <br />4. The following waste item was found inside a container labeled as ST HW (IMG 8519-20): <br />- An 8 oz metal aerosol can of Kenra Nitro Memory Creme (IMG 8521-3). According to the Ulta Potentially Hazarous <br />Waste Management posters, metal aerosol cans are to be placed in the Flammable Gas Hazardous Waste <br />container. When the aerosol can was scanned, the hand-held scanner did not indicate which hazardous waste <br />container the waste item should be placed in (IMG 8524). Christine stated that items that are not designated a <br />hazardous waste category on the scanner will automatically be placed into a State Managed Waste / Toxic <br />Hazardous Waste container. <br />5. The following waste item was found in a container labeled Battery Recycling Kit and observed on the floor next to <br />the hazardous waste storage area (IMG 8525-8528): <br />- A 5.39 oz container of Wella Eimi Shape Shift molding gum (IMG 8529-30). However, the hand-held scanner <br />identified the waste item as a corrosive acid (IMG 8531).
