OBSERVATION: Designated operator reports were not signed within the required time frame. Multiple designated operator reports were not signed and dated by the owner/operator. REGULATORY GUIDANCE:Within 48 hours of the completion of the designated UST operator visual inspection, the designated operator shall sign and provide the owner or operator with a copy of the inspection report. Within 72 hours of being provided a signed copy of the report,the owner or operator shall provide a description of each corrective action taken or to be taken and shall sign and date the report, acknowledging the identified compliance issues. CORRECTIVE ACTION: Ensure all designated operator inspection reports are completed and signed within the required time frame in the future. This is a repeat violation, Class II. 209 CCR 2715(c)(3), 2715(c)(4) Failure to maintain a copy of the"Facility Employee Training Certificate"on-site. OBSERVATION: The Facility Employee Training Certificate dated 3/26/2021 does not list initial training dates for employees trained. REGULATION GUIDANCE:All site employees must be trained prior to taking responsibility as a facility employee if after October 1, 2018, or within 30 days of hire if prior to October 1, 2018. The Facility Employee Training Certificate shall contain accurate information for all employees trained. CORRECTIVE ACTION: Update the Facility Employee Training Certificate to contain the accurate information and submit a copy of the updated form to the EHD. This is a minor violation. 304 CCR 2631(a); HSC 25290.1(c) Failure to construct, operate, and maintain primary containment as product-tight. OBSERVATION: Dispenser 11/12 was observed to have liquid seeping from the shear valve and liquid was observed at the bottom of the UDC indicating a leak in the primary containment. REGULATION GUIDANCE:All primary containment for the UST system must be product tight. CORRECTIVE ACTION: Immediately have a properly licensed,trained, and certified contractor repair or replace the failed component(s), under permit and inspection of the EHD if necessary.
