reduce impacts on migratory birds and their nests, if any are found, to a level that would
be less than significant.
Level of Significance: Potentially significant
Mitigation Measures:
BIO-2: If tree removal is scheduled during the nesting season of raptors
(January 1 through July 31), a pre-construction survey for nesting
raptors shall be conducted. If vegetation removal or construction
commences during the general avian nesting season (March 1 through
September 15), a pre-construction survey for all species of nesting birds
shall be conducted. If active nests for any bird species are found, work in
the vicinity of the nests shall be delayed until the young have fledged.
No surveys shall be required if tree removal occurs outside January 1
through July 31, or if other vegetation removal or construction occurs
outside March 1 through September 15.
Significance After Miti ag tion: Less than significant
e) Local Biological Requirements.
San Joaquin County Code Chapter 9-1505 contains provisions intended to preserve
Native Oak Trees and Heritage Oak Trees to the extent feasible. No oak trees would be
removed by the project, so this code chapter would not apply. There are no other
biological requirements that have been established by the County. The project would
have no impact on local biological requirements.
f) Conflict with Habitat Conservation Plans.
The County participates in the SJMSCP; as such, the project would comply with
applicable provisions and measures of the SJMSCP, as determined by SJCOG and as
required by Mitigation Measure BIO-1. No other habitat conservation plans apply to the
project site. The project would have no impact related to conflict with habitat
conservation plans.
3.5 CULTURAL RESOURCES
Less Than
Significant
Would the project: Potentially with Less Than
Significant Mitigation Significant
Impact Incorporated Impact No Impact
a)Cause a substantial adverse change in the significance of a
historical resource pursuant to Section 15064.5?
b)Cause a substantial adverse change in the significance of
an archaeological resource pursuant to Section 15064.5?
c)Disturb any human remains, including those interred
outside of formal cemeteries?
Pock Lane Public Review Draft IS/MND 3-23 May 2022
