Page 2 <br />Werner Enterprises <br />091-10076 <br />DESCRIPTION OF LOSS: <br />The Werner truck experienced a diesel fuel leak due to road debris puncturing the saddle <br />tank. The diesel fuel leaked into the soil on the shoulder of the highway, and onto the <br />asphalt shoulder. An estimated 50 gallons of diesel fuel was released. <br />SITE REMEDIATION: <br />Upon receipt of the assignment, we contacted the driver and obtained photos of the <br />immediate area of the diesel fuel spill, showing the majority of the puddling was occurring <br />on the asphalt shoulder and the adjacent soil. We contacted Patriot Environmental <br />Services (Patriot) to respond, and then reported the spill to the California Environmental <br />Protection Agency (CEPA) through the California Office of Emergency Services (CA-OES), <br />who issued report number 20-4345. <br />Patriot personnel arrived on site within two and a half hours and identified a trail of diesel <br />staining along the asphalt shoulder until the truck came to rest. The area impacted along <br />the asphalt shoulder was approximately 600 feet long X 1.5 feet wide. Patriot personnel <br />began excavating the impacted soil adjacent to the shoulder. While they were on site, two <br />California Department of Transportation (Caltrans) representatives arrived on scene and <br />oversaw the excavation. All of the impacted soil was placed into drums for disposal, and <br />Patriot's on-site project manager advised that the Caltrans's Hazmat Coordinator was <br />satisfied with the excavation of the diesel impacted soil. <br />The following day we were contacted by a Patriot remediation manager advising that <br />Caltrans was requiring additional remediation of the shoulder, the impacted pavement to <br />be removed and replaced, and the soil under the pavement to be excavated. We were <br />eventually able to confirm with the Hazmat Coordinator for the Caltrans that the <br />remediation of the shoulder was sufficient and could be backfilled, but that the <br />Maintenance Supervisor for Caltrans was still requiring the soil beneath the roadway to be <br />excavated while the roadway was being replaced. Caltrans advised that the work would <br />be required to take place at night and they would provide lane closure and oversight. <br />The remainder of the project was switched to Ancon, who completed the backfilling on <br />August 25, 2020. Ancon will subcontract the paving operations and be on site to perform <br />the soil excavation and backfilling after the roadway is removed. Due to the makeup of the <br />roadway base mixed with the possible diesel fuel that may have seeped through the <br />rubberized asphalt, we anticipate the soil being required to be disposed of as hazardous <br />waste. <br />Per our conversation with you on August 27, 2020, the submittal of the follow-up report <br />with the initial disposal is being submitted. Should additional excavation of soil beneath <br />the rubberized asphalt be required, we will submit the disposal manifests related to that <br />work to you in a closure report. Once the asphalt is removed, and if Caltrans does not <br />require additional soil excavation and disposal, we will notify you via email so that you may <br />close your file.
