PHS/EHD has prepared the following
comments for your consideration.
On December 26, 1997 PHS/EHD reviewed and approved the "Soil Contamination Containment Action
Plan" (enclosed) which San Joaquin Public Works (Public Works) had prepared. In light of the results and
recommendations which are presented within the Soil Sampling Report, PHS/EHD must rescind approval of
the Soil Contamination Containment Action Plan.
Please note that until such time as the contamination is properly characterized it should be considered as
suspected hazardous waste and as such falls under the regulatory authority of the Department of Toxic
Substance Control (DTSC) and Central Valley Regional Water Quality Control Board (CVRWQCB). The
training and authorization necessary for employees or contractors working on hazardous waste sites are
regulated by the Contractor's License Board and the Occupational Safety and Health Administration.
PHS/EHD does not have regulatory authority to work on hazardous waste sites unless agreements between
the DTSC, the CVRWQCB and a cooperative responsible party have been made with our agency. PHS/EHD
has discussed the site with the CVRWQCB and obtained verbal authorization to work on the site as an
environmental assessment, when it was believed to have been contaminated by petroleum hydrocarbons.
PHS/EHD does not have regulatory authority to provide directives on this site. PHS/EHD has already referred
the site to the CVRWQCB. For further information regarding site closure or regulatory requirements, please
contact the CVRWQCB.
If you have any questions, please do not hesitate to contact Margaret Lagorio at (209) 468-3449.
Donna Heran, REHS, Director
Environmental Health Division
Mary Meays, Senior REHS Margaret Lagorio, REHS
Site Mitigation Unit Lead Senior
cc: Wendy Cohen, Central Valley Regional Water Quality Control Board
A Division of San Joaquin County Health Care Services
