PHS/EHD has prepared the following <br />comments for your consideration. <br />On December 26, 1997 PHS/EHD reviewed and approved the "Soil Contamination Containment Action <br />Plan" (enclosed) which San Joaquin Public Works (Public Works) had prepared. In light of the results and <br />recommendations which are presented within the Soil Sampling Report, PHS/EHD must rescind approval of <br />the Soil Contamination Containment Action Plan. <br />Please note that until such time as the contamination is properly characterized it should be considered as <br />suspected hazardous waste and as such falls under the regulatory authority of the Department of Toxic <br />Substance Control (DTSC) and Central Valley Regional Water Quality Control Board (CVRWQCB). The <br />training and authorization necessary for employees or contractors working on hazardous waste sites are <br />regulated by the Contractor's License Board and the Occupational Safety and Health Administration. <br />PHS/EHD does not have regulatory authority to work on hazardous waste sites unless agreements between <br />the DTSC, the CVRWQCB and a cooperative responsible party have been made with our agency. PHS/EHD <br />has discussed the site with the CVRWQCB and obtained verbal authorization to work on the site as an <br />environmental assessment, when it was believed to have been contaminated by petroleum hydrocarbons. <br />PHS/EHD does not have regulatory authority to provide directives on this site. PHS/EHD has already referred <br />the site to the CVRWQCB.
