Thornton Road (APN 00115048), Thornton, CA
San Joaquin County Environmental Health Department (EHD) has received a letter dated May
26, 2006, from the professional law corporation of Hakeem, Ellis, and Marengo, written on behalf
of Ronald and Bonnie Barber, requesting oversight of the investigation of contamination at the
above-referenced site resulting from an unauthorized release of petroleum from underground
storage tanks be transferred to the Central Valley Regional Water Quality Control Board
(CVRWQCB). In compliance with Health and Safety Code Section 25296.10 (c )(6) and your
request, EHD is transferring the site to the CVRWQCB for oversight.
Previously, EHD oversight costs were invoiced to the SWRCB through the Local Oversight
Program contract and EHD did not handle the billing. Since you requested CVRWQCB be the
lead oversight agency, this case will be removed from the Local Oversight Program.
San Joaquin County Ordinance Code requires well permits be obtained from EHD whenever any
well or boring is constructed or destroyed, including boreholes for environmental investigation,
and that the fieldwork be inspected. EHD must charge for the staff time spent permitting and
inspecting these well/borings. The current hourly rate charged by EHD is $93. To process future
well/boring permit applications needed to conduct work required by CVRWQCB, an account must
be established with EHD. Enclosed is a Master File Record (MFR) for you to complete and return
to EHD with a payment of $279 (minimum three hours of work). This payment will be credited to
your account code for this site and is required before the next well/boring permit can be issued.
After the first three hours of work, staff time on your site will be multiplied by the hourly rate and
you will be billed accordingly.
The CVRWQCB will comment, direct, and approve investigation and remedial proposals and
EHD will continue to process and issue permits, and conduct grout inspections as required by
San Joaquin County Ordinance Code.
If you have any questions contact me at (209) 468-3449 or Harlin Knoll, Senior REHS at (209)
468-3442.
Donna Heran, REHS, Director
Environmental Health Department
Margaret Lagorio, Supervising REHS
Unit IV
Enc.
c: Hakeem, Ellis & Marengo — Michael Hakeem
San Joaquin County Public Works — Ron Rall
CVRWQCB — Jim Barton
SWRCB — Jennifer Jorden
