SAN J 0 A Q U 1 N Environmental Health Department <br /> U ; i y 1 Iii AMENDED <br /> 4/9/2021 <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> STOCKTON MOBIL 3* 1 2358 E WATERLOO RD, STOCKTON April 07, 2021 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br /> Environmental Reporting System (CERS)annually by the due date, January 15.The 2020 submittal was late, <br /> submitted on 1/16/20. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Ensure all submittals are made by the required due dates in the future. <br /> This is a Class II violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> OBSERVATION: No hazardous materials business plan (HMBP)training has been completed. The emergency <br /> response plan incorrectly states the UST designated operator training is being used. <br /> REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br /> receive initial and annual refresher training.All employees shall be trained in safety procedures in the event of a <br /> release or threatened release of a hazardous material, including, but not limited to,familiarity with the following <br /> plans and procedures: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br /> years. <br /> CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br /> training records to the EHD. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> An inspection checklist was provided to the facility operator on the day of inspection. A complete report was <br /> finished on April 9, 2021 and replaces the initial checklist. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, within 30 days of receiving the complete inspection report. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign.
