a <br /> California Tntegrated Tl:ct .."iag awant Board <br /> Penait Decision No. 95-50 <br /> March 29, 1995 <br /> WHEREAS, the Forward, Inc. owns and operates the Forward <br /> Resource Recovery Facility; and <br /> WHEREAS, the San Joaquin County Environmental Health <br /> Division, acting as the Local Enforcement Agency (LEA) , requested <br /> that the operator submit an application for a revised Solid Waste <br /> Facility Permit; and <br /> WHEREAS, the San Joaquin County Community Development, the <br /> lead agency for CEQA review, prepared an Environmental Impact <br /> Report (EIR) for the proposed project; and Board staff provided <br /> comments to the County on December 20, 1992; and the proposed <br /> project will have a significant effect on the environment; and <br /> mitigation measures were incorporated into the approval of the <br /> proposed project; and the San Joaquin County Board of Supervisors <br /> E111% n�•rt 92032013) , r.l.,r7„•.,.. �' <br /> adopted the Final (x.I'M in.._�,.._._g a fin i..ng of <br /> overriding considerations, on September 16, 1993, and approved <br /> the Notice of Determination for the project on September 29, <br /> 1993 ; and <br /> WHEREAS, the operator' s new Waste Discharge Requirements <br /> (WDRs) were adopted by the Central Valley Regional Water Quality <br /> Control Board (CVRWQCB) on January 28, 1994; and <br /> WHEREAS, the LEA has submitted to the California Integrated <br /> Waste Management Board (Board) for its, review and concurrence <br /> in, or objection to, a revised Solid Waste Facilities Permit for <br /> the Forward Resource Recovery Facility;. and <br /> WHEREAS, the project description in the CEQA document is <br /> consistent with the proposed permit; and <br /> WHEREAS, Board staff have evaluated the proposed permit for <br /> consistency with the standards adopted by the Board and found the <br /> facility design and operation in compliance with State Minimum <br /> Standards; and <br /> WHEREAS, the Board fi:ids that all 5tdte and local <br /> requirements for the proposed permit have been met, including <br /> consistency with Board standards, conformance with the County <br /> Solid Waste Management Plan, consistency with the County General <br /> Plan, and compliance with CEQA; and <br /> WHEREAS, there is no evidence in the record to indicate that <br /> the issuance of the permit would prevent or substantially impair <br /> the jurisdictions' achievement of the diversion requirements <br /> prescribed in Public Resources Code Section 41780; and <br />
