Enforcement The 7 July 2011 Order for Technical Reports was issued pursuant to Water Code section 13267. Section 13268 of the California Water Code states, in part: "Any person failing or refusing to furnish technical or monitoring program reports as required by subdivision (b) of section 13267, or failing or refusing to furnish a statement of compliance as required by subdivision (b) of section 13399.2, or falsifying any information provided therein, is guilty of a misdemeanor and may be liable civilly in accordance with subdivision (b). (b)(1) Civil liability may be administratively imposed by a regional board in accordance with Article 2.5 (commencing with section 13323) of Chapter 5 for a violation of subdivision (a) in an amount which shall not exceed one thousand dollars ($1,000) for each day in which the violation occurs." Due to failure to submit a cover design that meets the performance standard of Title 27, our next step is to recommend that civil liability (i.e. monetary penalties) be assessed against San Joaquin County Public Works Department and California Department of Transportation. As of 15 March 2012, the maximum liability for delinquent monitoring reports from 10 October 2011 through 15 March 2012 is $158,000. However, we will not recommend that our Executive Officer issue an administrative civil liability if the Dischargers submit a revised design that meets the performance standard of Title 27 by 25 April 2012, and the waste is covered during the 2012 construction season, as proposed in the County's 14 March 2012 letter.
