Explained that the release has been stopped and contained. Generated a total of five 55 <br />gallon drums of oily solids. <br />All generated clean up wastes must be transported according to all applicable manifesting procedures (HSC25160 (b)(3)) <br />and disposed of according to all applicable Title 22 regulations. The disposal of any hazardous waste, or the causing there <br />of, is prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br />[HSC25189.5 (a).] <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />° Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />ORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Submit copies of hazardous waste manifests/disposal records to the END. <br />Five 55 gallon drums with oily solids. <br />Manage the waste according to Title 22 California Code of Regulations for hazardous waste.
