SIERRA DELTA CORPO TION 5611 East flitterloo Road EXECUTIVE SUMMARY SIERRA DELTA CORPORATION ("SDC") conducted a Phase I Environmental Site Assessment ("ESA") for the property identified as Assessor's Parcel Number ("APN") 087-100- 52. The ESA was requested by Ms. Sally Warner and conducted between November 4, 2008 and December 23, 2008. The address associated with the Subject Property is: 5611 East Waterloo Road, Stockton, CA 95215. Summary of Findings Based on the on-site and off-site reconnaissance, interviews with agencies, the regulatory records review, aerial photographs, a review of ownership / use history, and review of any previous available documents prepared for the Subject Property, SDC found that this assessment has revealed evidence of potential recognized environmental conditions' on or associated with the Subject Property. For a detailed summary, the reader is referred to Section 5- Findings and Conclusions of this report. The Subject Property is currently operating as a permitted gasoline station with a convenience store. The facility has three double walled underground storage tanks monitored electronically by a Gilbarco Electronic Monitoring Console. The San Joaquin County EHD was contacted regarding files pertaining to the Subject Property. The files were unavailable for review due to an ongoing investigation / enforcement issue with the Subject Property. The file has been turned over to the District Attorneys office for further investigation. A copy of the EHD letter titled; Public Records Unavailability Notice, is attached herein Appendix E. The owner of the property provided documentation (from the testing company) regarding the equipment testing at the facility. The property appears to have all facility equipment in operational compliance (All equipment testing was conducted by an independent third party, repaired if necessary, and passed testing). The latest site inspection dated 10/14/08 identified minor violations that were corrected at the time of the inspection. The file is still at the District Attorneys office, and they informed SDC that they could not discuss the file as it was an ongoing investigation. The following were the latest test dates identified for the Subject Property; Annual Monitoring Certification was last conducted on 10/14/2008. Secondary Containment Testing was last conducted on 07/30/2007. The term recognized environmental conditions means the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property . The term includes hazardous substances or petroleum products even under conditions in compliance with laws. The term is not intended to include de minimis conditions that generally do not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies.
