SIERRA DELTA CORPO TION 5611 East flitterloo Road <br />EXECUTIVE SUMMARY <br />SIERRA DELTA CORPORATION ("SDC") conducted a Phase I Environmental Site <br />Assessment ("ESA") for the property identified as Assessor's Parcel Number ("APN") 087-100- <br />52. The ESA was requested by Ms. Sally Warner and conducted between November 4, 2008 and <br />December 23, 2008. The address associated with the Subject Property is: 5611 East Waterloo <br />Road, Stockton, CA 95215. <br />Summary of Findings <br />Based on the on-site and off-site reconnaissance, interviews with agencies, the regulatory <br />records review, aerial photographs, a review of ownership / use history, and review of any <br />previous available documents prepared for the Subject Property, SDC found that this <br />assessment has revealed evidence of potential recognized environmental conditions' on or <br />associated with the Subject Property. For a detailed summary, the reader is referred to <br />Section 5- Findings and Conclusions of this report. <br />The Subject Property is currently operating as a permitted gasoline station with a convenience <br />store. The facility has three double walled underground storage tanks monitored <br />electronically by a Gilbarco Electronic Monitoring Console. <br />The San Joaquin County EHD was contacted regarding files pertaining to the Subject <br />Property. The files were unavailable for review due to an ongoing investigation / enforcement <br />issue with the Subject Property. The file has been turned over to the District Attorneys office <br />for further investigation. A copy of the EHD letter titled; Public Records Unavailability <br />Notice, is attached herein Appendix E. <br />The owner of the property provided documentation (from the testing company) regarding the <br />equipment testing at the facility. The property appears to have all facility equipment in <br />operational compliance (All equipment testing was conducted by an independent third party, <br />repaired if necessary, and passed testing). The latest site inspection dated 10/14/08 identified <br />minor violations that were corrected at the time of the inspection. The file is still at the <br />District Attorneys office, and they informed SDC that they could not discuss the file as it was <br />an ongoing investigation. <br />The following were the latest test dates identified for the Subject Property; <br />Annual Monitoring Certification was last conducted on 10/14/2008. <br />Secondary Containment Testing was last conducted on 07/30/2007. <br />The term recognized environmental conditions means the presence or likely presence of any hazardous substances or <br />petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release <br />of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface <br />water of the property . The term includes hazardous substances or petroleum products even under conditions in compliance with <br />laws. The term is not intended to include de minimis conditions that generally do not present a material risk of harm to public <br />health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of <br />appropriate governmental agencies. <br />NVIRONMENTAI SI I I '
