The Water Code further requires the State Water <br /> Resources Control Board to rank all solid waste disposal sites within the State. <br /> This ranking determines the schedule (150 sites per year) for disposal sites to <br /> prepare SWAT reports. <br /> The Harney Lane Sanitary Landfill is listed as a Rank 5. This means that the <br /> City is required to perform a SWAT on this site during the period 1 July 1990 <br /> to 30 June 1991. The SWAT Investigation consists of two phases. The first phase <br /> involves the preparation of a SWAT Proposal. After Regional Board review and <br /> approval of the SWAT Proposal , the SWAT Investigation is completed and a final <br /> report sent to the Regional Board. Guidance for preparing both a SWAT Proposal <br /> and SWAT Report, along with a copy of Section 13273, are enclosed with this <br /> letter. <br /> Normally, a SWAT Proposal would be requested by 1 January 1990 for your site. <br /> However, state funding will likely not be available for the Regional Board to <br /> review SWAT proposals for Rank 5 sites during the current State Fiscal Year, <br /> which runs from 1 July 1989 - 30 June 1990. Therefore, we are not requesting <br /> that you submit a SWAT Proposal by 1 January 1990. ' Should funding become <br /> available for this work at the Regional Board, we will notify you. We suggest <br /> that you consider the requirements of Water Code Section 13273 and decide whether <br /> you wish to proceed or plan to do a SWAT. <br /> Under certain instances, the disposal site operator/owner may request a waiver <br /> of the SWAT requirement if monitoring information can conclusively demonstrate <br /> that hazardous wastes are migrating from the site into waters of the State.
