Following the third inspection, an evaluation of overall facility compliance with State Minimum Standards will be made based on the results of all three staff inspections and other pertinent information. If the results indicate repeated and/or uncorrected violation(s) of one or more standard(s) , staff may recommend that the Board propose the site for inclusion on the State List of Non-Complying Facilities (List) . If the Board proposes a facility for the List, the affected operator will be notified by certified mail. After 90 days from the date of notice or upon notification that all violations have been corrected, Board staff will re-inspect the facility. If the facility is still in violation, the site will be placed on the List. If a facility is included on the List, Government Code 66796.39 requires the Local Enforcement Agency (LEA) to develop a compliance schedule for correction of the violation(s) . If compliance is not achieved within one year of the date the site is placed on the List, Government Code Section 66796.39 directs the LEA to revoke the facility operating permit until such time as the violation(s) of the standard(s) are remedied. The goal of the field evaluation program is to verify compliance with each State Minimum Standard, not merely to document violations. Inspecting each facility three times over a period of approximately one year will provide a track record of compliance at each facility. It and will also allow for the proper evaluation of standards which show seasonal variation such as drainage, erosion control, and dust. Although we do not intend to provide advance notice of the inspection dates to operators, the Local Enforcement Agency (LEA) will be notified and will be invited to accompany our staff on inspections.
