Whittaker <br /> 12945 Eberhard Road <br /> Lodi, CA 95240 <br /> Dear Mr. Whittaker: <br /> Governor Deukmejian requested that i respond to your recent letter <br /> concerning the Harney-,-Lane,,,, : e t1T .' We share your concerns about <br /> proper solid waste management and disposal to ensure that no public <br /> health, safety, and environmental problems arise. <br /> We are aware of the current activities concerning the height of the <br /> Harney Lane Landfill. When the solid waste facility permit was issued <br /> in March, 1978 maximum final elevations were not stipulated. At that <br /> time it was expected that upon closure the landfill would have a very <br /> flat top surface. Recent regulations adopted by the California Water <br /> Quality Control Board require that all final surfaces of disposal <br /> sites be designed to provide slopes of at least three percent. . This <br /> requirement is to protect against water ponding over the fill areas, <br /> subsequent infiltration through the soil cover, and leaching through <br /> the wastes. Such leaching could cause groundwater or surface water <br /> contamination. Because of this requirement the landfill needs to <br /> increase its height to allow for the proper slopes. The alternative <br /> would be to excavate the landfill sides to bring it to the proper <br /> grade. Waste excavation can result in more environmental harm through <br /> the creation of odors, safety hazards from landfill gas, noise, <br /> unsightliness; and potential of water infiltration into the exposed <br /> wastes. Therefore, raising the height appears to be the most <br /> environmentally sound alternative® <br /> Even if there were no advantage to raising the height, the State of <br /> California cannot directly limit the landfill's final height. <br /> This kind of land use decision is within the exclusive jurisdiction <br /> of the San Joaquin County Board of Supervisors. I recommend that you <br /> continue to express your concerns to that body through the public <br /> hearing process. <br /> The California Waste Management rd's designated Local Enforcement <br /> Agency (San Joaquin County Local Health District) will continue to <br /> enforce the State Minimum Standards for Solid Waste Handling and <br /> e <br /> VE <br />
