a <br /> (b) For any period during which Harney Lane Landfill is <br /> operated at a loss, City agrees to pay County seven <br /> percent (7%) of the collections made by City. In the <br /> event that the annual financial statement, required by <br /> that certain agreement dated January 2, 1975, between City <br /> and County regarding Harney Lane Sanitary Landfill, shows <br /> that County has operated Harney Lane Landfill at a profit, <br /> then said percentage figure shall be reduced from seven <br /> percent (7%) to a minimum of three percent (3%) . There- <br /> after for each ensuing fiscal year a similar adjustment <br /> will be made by the City and County following the above- <br /> referenced formula within the limitations set forth herein. <br /> (c) It is County' s intent to operate Harney Lane Landfill <br /> on a break-even basis. In the event any monies or <br /> credits are due either party by reason of the adjustments <br /> contemplated by subparagraph (b) , said payments or <br /> credits shall cover the preceding 12 months. Payment <br /> of any monies or allowance of any credit shall be made <br /> within 60 days after the end of each fiscal year during <br /> the period of this Agreement. <br /> 10. This Agreement shall continue in effect unless voided by <br /> State action, except that either party may terminate the Agreement <br /> by giving four years written notice of its intention to terminate <br /> to the other party. <br /> IN WITNESS WHEREOF, the parties hereto have executed this <br /> 3 - <br />
