BACKGROUND: <br /> On 7 February 2018, the Central Valley Regional Water Quality Control Board (Central Valley Water <br /> Board) Executive Officer issued a Notice of Applicability (NOA) to Harvest Power California, LLC (the <br /> Discharger)for the Harvest-Lathrop Composting Facility (Facility) for coverage under Water Quality <br /> Order 2015-0121-DWQ, General Waste Discharge Requirements for Composting Operations (General <br /> Order). The NOA required the Discharger by 1 November 2018 to make improvements such as <br /> construction/reconstruction of Wastewater Detention Ponds 1 and 2, associated pan lysimeters, and <br /> enough of the working pad area, access roads, and drainage ditches that feed the detention ponds to <br /> allow the Discharger to operate through the 2018-2019 wet season, including piezometers for <br /> groundwater separation monitoring. <br /> On 30 April 2018 the Discharger met with Central Valley Water Board staff to discuss a proposed <br /> change to their NOA. Due to a potential future expansion of the facility the Discharger proposed <br /> moving its Detention Pond #2 from the approved location along the western edge of the facility to the <br /> southern end of the facility. <br /> On 28 November 2018, the Central Valley Water Board Executive Officer issued an amended Notice <br /> of Applicability (NOA) which addressed the relocation of Detention Pond #2. The amended NOA did <br /> not change any compliance dates specified in the 7 February 2018 NOA. <br /> On 29 November 2018, a conditional approval letter was sent to the Discharger for facility <br /> improvements documented in final plans, specifications, and a Construction Quality Assurance Plan. <br /> On 5 December 2018, Central Valley Water Board staff performed a site visit of Harvest-Lathrop <br /> Composting Facility (TMRTS)to observe current site conditions at the onset of the 2018-2019 wet <br /> season and to observe any site improvements the Discharger may have made to meet the 1 <br /> November 2018 compliance deadline stated in the 7 February 2018 NOA. <br /> 2. OBSERVATIONS AND COMMENTS: <br /> On 5 December 2018, Central Valley Water Board staff arrived at the facility at approximately 12:45 <br /> PM. The weather was partly cloudy. Photographs were taken at locations shown in Attachment 1. <br /> Attachment 2 includes some photographs that were taken. Photo 1 shows rutting of the existing <br /> compost working surface due to equipment traffic. The existing compacted soil is unable to provide an <br /> all-weather working surface as required by the General Order.
