Site Access Agreement <br /> Page 1 of 1 <br /> SITE ACCESS AUTHORIZATION <br /> I, the undersigned, as the owner of the real property described below, hereby authorize <br /> American Geological Services, Inc. (AGS) personnel access to my property for the <br /> purpose of the collection of representative soil and/or water samples. Further, AGS will <br /> have access to all areas of the property for the purpose of conducting site reconnaissance <br /> activities in fulfillment of the proposed scope of work. I agree to the terms listed below: <br /> • Site entry/access will be readily provided by the property owner or his authorized <br /> agent. <br /> • Property owner will readily provide information about present or former land use and <br /> conditions, or known potential physical or chemical hazards when, or if, requested. <br /> • All building plans, blueprints, specifications, previous surveys, etc. will be available <br /> for review by AGS at the time of the survey, if requested. <br /> • Property owner will permit AGS to collect samples of soil and/or water from the <br /> property. Care will be taken to minimize surface damage and disruption of the <br /> sampling areas. Some disruption will occur as a result of sampling, and property <br /> owner acknowledges and accepts such disruptions. <br /> • This scope of work does not include any costs for the treatment, disposal, removal, or <br /> handling of any hazardous materials or conditions identified. <br /> • Property owner acknowledges that AGS is an independent third party and has no <br /> vested interest in the results of the investigation. As such, property owner recognizes <br /> that the property owner and AGS owe a duty of care to the public that requires them <br /> to conform to applicable codes, standards, regulations and ordinances, principally to <br /> protect public health and safety. AGS will do its best to alert its client to any matter <br /> that requires immediate action to protect public health and safety or conform to <br /> applicable codes, standards, regulations or ordinances. Should our client decide to <br /> disregard AGS' recommendations in these respects, our client agrees that AGS has <br /> the right to employ its best judgment in deciding whether or not to notify property <br /> owner, public officials or take other appropriate action. Our client agrees that AGS <br /> shall not be held liable in any respect for reporting or failing to report said conditions. <br /> Accordingly, client and property owner agrees, to the fullest extent permitted by law, <br /> to indemnify and hold AGS harmless from any claim, liability or cost (including <br /> reasonable attorneys' fees and costs of defense) for injury or loss arising or allegedly <br /> arising from AGS' notifying or failure to notify public officials. <br />
