Site Access Agreement Page 1 of 1 SITE ACCESS AUTHORIZATION I, the undersigned, as the owner of the real property described below, hereby authorize American Geological Services, Inc. (AGS) personnel access to my property for the purpose of the collection of representative soil and/or water samples. Further, AGS will have access to all areas of the property for the purpose of conducting site reconnaissance activities in fulfillment of the proposed scope of work. I agree to the terms listed below: • Site entry/access will be readily provided by the property owner or his authorized agent. • Property owner will readily provide information about present or former land use and conditions, or known potential physical or chemical hazards when, or if, requested. • All building plans, blueprints, specifications, previous surveys, etc. will be available for review by AGS at the time of the survey, if requested. • Property owner will permit AGS to collect samples of soil and/or water from the property. Care will be taken to minimize surface damage and disruption of the sampling areas. Some disruption will occur as a result of sampling, and property owner acknowledges and accepts such disruptions. • This scope of work does not include any costs for the treatment, disposal, removal, or handling of any hazardous materials or conditions identified. • Property owner acknowledges that AGS is an independent third party and has no vested interest in the results of the investigation. As such, property owner recognizes that the property owner and AGS owe a duty of care to the public that requires them to conform to applicable codes, standards, regulations and ordinances, principally to protect public health and safety. AGS will do its best to alert its client to any matter that requires immediate action to protect public health and safety or conform to applicable codes, standards, regulations or ordinances. Should our client decide to disregard AGS' recommendations in these respects, our client agrees that AGS has the right to employ its best judgment in deciding whether or not to notify property owner, public officials or take other appropriate action. Our client agrees that AGS shall not be held liable in any respect for reporting or failing to report said conditions. Accordingly, client and property owner agrees, to the fullest extent permitted by law, to indemnify and hold AGS harmless from any claim, liability or cost (including reasonable attorneys' fees and costs of defense) for injury or loss arising or allegedly arising from AGS' notifying or failure to notify public officials.
