Mr. Blake Rasmussen 24 July 1996 <br /> Golden Gate Fresh Foods <br /> Joaquin County, will be used by Golden Gate to clean up the site in a manner that will protect water <br /> quality. We understand that Golden Gate had planned to use the sale proceeds to pay off its creditors. <br /> However, the Regional Board believes that any monies should instead be used to protect the <br /> environment and the neighbors. A release of liability would also be conditioned on use of the site in a <br /> manner that does not exacerbate the existing pollution of the soil or ground water, or cause new sources <br /> of pollution. <br /> In light of the Regional Board's concerns, we would recommend that the Board consider granting a <br /> release of liability, at a public meeting, if the following conditions are met. <br /> i. Removal of the Class II Surface Impoundment, also referred to as the E/ESB. Regrading <br /> and compacting the soils in this area to inhibit percolation of precipitation. <br /> ?. Regrading of soils over the percolation pond to the north of the E/ESB and compaction of <br /> these soils to inhibit percolation of precipitation. Paving of certain areas to prevent <br /> percolation of precipitation and downward leaching of salt to ground water. <br /> 3. Conclusion of an agreement with the federal EPA regarding closure of the injection well. <br /> 4. Monitoring and analysis of the existing plume that determines that after the proposed site <br /> remediation, and under the proposed future use of the site, the ground water plume doe not <br /> pose a threat to existing or anticipated water use in the area. Ongoing monitoring of site <br /> monitoring wells 1 through 6 for water quality parameters characteristic of the salt pollution <br /> such as total dissolved solids and chloride. <br /> 3. Use of the proceeds of the property sale to establish a fund for future corrective actions at <br /> Jhe site. The proceeds would be established after property taxes were paid, commissions on <br /> :he sale and other costs of making the sale. A report must be submitted showing the full <br /> sale price, the deductible amounts, and the specific uses of the proceeds at the site. <br /> We believe that a release of liability under the conditions set forth herein would accomplish both <br /> protection of the ground water and improve the ability to change this "brownfields" site into a <br /> productive economic site. If you intend to pursue this matter, please let me know when you will provide <br /> the necessary monitoring report and a report detailing the improvements Mr. Douglas and Golden Gate <br /> %vill make at the site. <br /> If you have any questions, please call me at (916) 255-3140. <br /> WILLIAM J.
