Cleanup activities at the Property have been successful in removing some of the salt <br /> contamination from the A-zone aquifer and have provided an alternate supply of water to neighbors <br /> affected by the pollution plume. Despite remediation of groundwater and the decline in salinity <br /> concentrations in the A-zone aquifer, groundwater concentrations do not yet meet water quality <br /> objectives. Continued monitoring of the pollutant plume is needed to determine the threat posed by the <br /> existing pollutant plume and any decline in concentrations due to diffusion. <br /> H. DEFINITIONS <br /> Unless otherwise expressly provided herein,terms used in this Agreement that are defined in the <br /> California Water Code have the meaning assigned to them in the California Water Code. <br /> 2.1 "California Regional Water Quality Control Board, Central Valley Region"shall mean the <br /> State of California, Environmental Protection Agency,Regional Water Quality Control Board, Central <br /> Valley Region, and any successor agency of the State of California that may have responsibility for and <br /> jurisdiction over the subject matter of this Agreement. <br /> 2.2 "Douglas" or"Released Parties", for purposes of this Agreement, includes the individual <br /> Vfichael Douglas and his successors and assigns, by virtue of Douglas' ownership of the Property. <br /> Douglas did not cause the Known Conditions at the Property, and was not prior to 1998, an <br /> owner of the Property. <br /> 2.3 "Known Conditions" shall mean any waste, as defined in the California Water Code, present <br /> or existing at, on, or under(including within the groundwater beneath) the Property, that was disclosed <br /> to the Board or is reasonably discernible from the report [give date and title of report] previously <br /> submitted to the Board, as of the date Douglas takes possession of the Property, but does not include <br /> discharges to soil or ground water that may have occurred from underground tanks known to be present <br /> at the Property. <br /> 2.4 "Parties" shall mean the Board and Douglas. <br /> III. AGREEMENT' <br /> 3.1 Cleanup and Abatement Actions. Douglas agrees to complete the following tasks according <br /> to the specified time schedules: <br /> A. Provide a permanent water supply for the Warmerdam's property and any other <br /> properties whose water supply has been impacted by the waste discharged from the <br /> Property. A permanent water supply could include replacement wells or a binding <br /> agreement which would guarantee a water supply for such impacted properties. <br /> B. Submit a workplan to the Board and County of San Joaquin, and after approval remove <br /> the underground petroleum storage tanks in accordance with County and State regulatory <br /> requirements.
