lent By: Tracy orcnare; Bab 2y9b; Apr-2t -ub i :uarm; rage 0/10 <br /> N nc'B1V8tl' 4/27/05 12:50PM; 125e420213 -s ir*R Y I_�_ - <br /> -CHEVRON ENC 9258420213 04/20 '05 13:35 N0.436 03/16 <br /> Vernalis Pump Station Offsite,City or'rritcy,San Joaquin County <br /> SIS ACCESS AGREEMENT <br /> This Site Access Agreement is entered into as of the date executed below by and <br /> between Chevron U.S.A.Inc.,a Pennsylvania corporation by and through its contract <br /> operator,Chevron Environmental Management Company,a California corporation, <br /> (hereinafter"ChevronTexaco")and Michael&L.Dogetti.(hereinafter"Owner"). <br /> WHEREAS,Owner holds record title to a certain real property located north- <br /> northeast of the intersection of Welty Road and Highway 33 (parcel'number 255-260-16) <br /> in.the City of Tracy,and said parcel is situated in the County of San,Joaquin,State of <br /> California,hereinafter(the"Property");and <br /> WHEREAS,Standard Oil Company of California,the predecessor to Chevron <br /> U.S.A.Inc.,operated a crude oil/Aunker C fuel oil boostortheater station(also referred to <br /> as the Vemalis Pump Station)on a right-of-way adjacent to and upgradient of the <br /> Property;and <br /> WHEREAS, ChevronTexaco conducted several investigations to determine the <br /> extent ofpetroleum hydrocarbon-atf'ectod soil and groundwater on real property located <br /> adjacent to the Property which were conducted from 1995 to 2003;and <br /> WHEREAS, ChevronTexaco desires to continue its investigation activities which <br /> will include activities on the Property; and <br /> WHEREAS,certain.governmental agencies may request CkevronTexaco to <br /> perform additional*valuation of the residual Petroleum hydrooarbon-afiFected soil and <br /> groundwater at and in the vicinity of the Property;the additional evaluation,may include <br /> the installation of groundwater monitoring wells or piezometers. <br /> NOW THEREFORE,in consideration of the material promises contained <br /> herein,the parties agree as follows: <br /> i. As part of its assessment of environmental conditions present on the Property, <br /> ChevronTexaeo desires access to the Property to perform assessment activities <br /> to deiinc the extent,if any,ofpetrolevin hydrocarbon-ai)bcted soil and <br /> groundwater present on the,Property.Owner grants ChevronTexaco <br /> reasonable access to the Property provided that reasonable advance notice is <br /> provided to Owner by ChevronTexaco of its desire for access. Owner shall <br /> thereafter provide written verification and consent to ChcvronTexaco that it <br /> may enter upon the Property for the purpose of perEorming an environmental <br /> site assessment of surface and sub-surke conditions. Said assessment may <br /> include soil and groundwater delineation and sampling activities and the <br /> installation of monitor wells if such installation is deame l by ChevrouTexaco <br /> to be prudent practice.
