water mark". The ordinary high water mark is established by physical
characteristics such as a natural water line impressed on the bank, presence of
shelves, destruction of terrestrial vegetation, or the presence of litter and debris.
Jurisdictional wetlands are vegetated areas that meet specific vegetation, soil,
and hydrologic criteria defined by the ACOE Wetlands Delineation Manual and
Regional Supplement (ACOE, 1987; 2008). Jurisdictional wetlands are usually
adjacent to or hydrologically associated with Waters of the U.S. Isolated
wetlands are outside federal jurisdiction, but may be regulated by RWQCB under
the State Wetlands Program.
The only potentially jurisdictional Water of the U.S or wetland in the project site is
Duck Creek, which flows through the site. The section of Duck Creek in the site
is trapezoidal in shape with a mean width of 25 feet. The potential jurisdictional
limit of Duck Creek is defined by an ordinary high water mark (OHWM). The
creek flows east to west and conveys water from season storms, as well as
agricultural tail water much of the year. Emergent wetland vegetation in the
portion of Duck Creek within the site boundary is limited (see photographs in
Attachment C). In contrast, the section of the creek adjacent to the south edge of
the side supports a notable stand of tules and cattails.
Duck Creek is depicted as a "blue -line" stream on the USGS topographic map
(Figure 2) and as a Riverine feature on the National Wetland Inventory (NWI)
map (Attachment D). Duck Creek is tributary to the San Joaquin River and the
San Joaquin River is a navigable jurisdictional water of the U.S. The tributary
relationship of Duck Creek to the San Joaquin River forms the basis for it being
potentially jurisdictional Waters of the U.S. and under the jurisdiction of agencies
including ACOE, CDFW, and the RWQCB. Duck Creek also falls under the
jurisdiction of the CVFPB. The project will involve no work in Duck Creek.
SPECIAL -STATUS SPECIES: Special -status species are plants and animals that are
legally protected under the state and/or federal Endangered Species Act or other
3009 Pock Lane: Biology 11 November 24, 2021
