reduce impacts on migratory birds and their nests, if any are found, to a level that would <br />be less than significant. <br />Level of Significance: Potentially significant <br />Mitigation Measures: <br />BIO -2: If tree removal is scheduled during the nesting season of raptors <br />(January 1 through July 31), a pre -construction survey for nesting <br />raptors shall be conducted. If vegetation removal or construction <br />commences during the general avian nesting season (March 1 through <br />September 15), a pre -construction survey for all species of nesting birds <br />shall be conducted. If active nests for any bird species are found, work in <br />the vicinity of the nests shall be delayed until the young have fledged. <br />No surveys shall be required if tree removal occurs outside January 1 <br />through July 31, or if other vegetation removal or construction occurs <br />outside March 1 through September 15. <br />Significance After Miti ag tion: Less than significant <br />e) Local Biological Requirements. <br />San Joaquin County Code Chapter 9-1505 contains provisions intended to preserve <br />Native Oak Trees and Heritage Oak Trees to the extent feasible. No oak trees would be <br />removed by the project, so this code chapter would not apply. There are no other <br />biological requirements that have been established by the County. The project would <br />have no impact on local biological requirements. <br />f) Conflict with Habitat Conservation Plans. <br />The County participates in the SJMSCP; as such, the project would comply with <br />applicable provisions and measures of the SJMSCP, as determined by SJCOG and as <br />required by Mitigation Measure BIO -1. No other habitat conservation plans apply to the <br />project site.
