Exhibit A <br /> Multi-Modal Station/Shopping Center Phase II ESA <br /> Page 7 <br /> TASK F <br /> Findings and Report Preparation <br /> A written report will be prepared upon completion of Tasks A through F detailing the findings of <br /> the Phase II groundwater and soil investigation fieldwork and the laboratory analytical results. <br /> The report will not include a health or risk assessment for the properties. <br /> SCHEDULE <br /> Condor will commence site assessment activities upon receipt of a signed contract and written <br /> authorization to access the properties (to be acquired by DHR). Condor anticipates fieldwork can be <br /> completed in three weeks and that a draft, site assessment report can be completed within 5 weeks of <br /> completion of fieldwork. Assuming there are no significant changes to the draft report, a final report will <br /> be submitted within one week of receipt of the final draft comments. <br /> SITE ACCESS AND SITE CONDITIONS <br /> DHR will grant or obtain free access to the site for all equipment and personnel necessary for Condor to <br /> perform the work set forth in this scope of work to the extent possible as described in Section 4.6 of the <br /> Agreement. Condor will take reasonable precautions to minimize damage to the site, but it is understood by <br /> DHR that, in the normal course of work, some damage may occur and the correction of such damage shall <br /> be performed in accordance with Section 4.6 of the Agreement. Please find Section 4.6 for your reference <br /> below. <br /> Section 4.6 Right to Enter; Effects of Entry <br /> AGENCY shall,to the extent required to perform the scope of services, provide to <br /> or secure for CONSULTANT's use, the right to enter the property owned by persons <br /> and/or entities other than AGENCY. As to AGENCY property identified in the scope of <br /> services, the right to enter for the purpose of conducting the services hereunder is granted. <br /> In the event that physically invasive activities are included in the scope of services, the <br /> service provider shall return the property to its then current or better condition upon <br /> completion of the work. As to AGENCY owned property, AGENCY recognizes that the <br /> discovery of certain conditions previously existing on the property and not caused or <br /> created by CONSULTANT may affect the value of the property. <br /> DISCOVERY OF UNANTICIPATED HAZARDOUS MATERIALS <br /> Condor agrees to notify DHR when unanticipated hazardous materials or suspected hazardous materials <br /> are encountered per Section 4.12 of the Agreement. DHR agrees to make any disclosures required by law <br /> to the appropriate governing agencies. In the event the project site is not owned by DHR, DHR <br /> recognizes that it is DHR's responsibility to inform the property owner of the discovery of unanticipated <br /> hazardous materials or suspected hazardous materials. <br /> LIMITATIONS <br /> The scope of work for this proposal is intended to provide a limited investigation into the possible <br /> presence of contamination or pollution ("recognized environmental condition" ASTM Standard E 1527- <br /> 00, Sec. 1.1.1) at or beneath the site. This Phase II ESA is not intended to identify all potential concerns <br /> or to eliminate all risk for the subject properties bearing some degree of environmental liability. Condor <br /> cannot, and will not, warrant or certify that the site is free of contaminants because it is impossible to <br />
