STANDARD PROVISIONS AND REPORTING REQUIREMENTS -3 <br />National Pollutant Discharge Elimination System <br />The Discharger shall furnish, within a reasonable time, any <br />information the Board or EPA may request to determine compliance with <br />this Order or whether cause exists for modifying or terminating this <br />Order. The Discharger shall also furnish to the Board, upon request, <br />copies of records required to be kept by this Order. <br />9. If a toxic effluent standard or prohibition (including any scheduled <br />compliance specified in such effluent standard or prohibition) is <br />established under Section 307(a) of the CWA, or amendments thereto, <br />for a toxic pollutant that is present in the discharge authorized <br />herein, and such standard or prohibition is more stringent than any <br />limitation upon such pollutant in this Order, the Board will revise <br />or modify this Order in accordance with such toxic effluent standard <br />or prohibition. <br />The Discharger shall comply with effluent standards and prohibitions <br />within the time provided in the regulations that establish those <br />standards or prohibitions, even if this Order has not yet been <br />modified. <br />10. If more stringent applicable water quality standards are approved, <br />pursuant to Section 303 of the CWA, or amendments thereto, the Board <br />will revise and modify this Order in accordance with such more <br />stringent standards. <br />11. This Order shall be modified, or alternately revoked and reissued, to <br />comply with any applicable effluent standard or limitation issued or <br />approved under Sections 301(b)(2)(C) and (D), 304(b)(2), and <br />307(a)(2) of the CWA, if the effluent standard or limitation so <br />issued or approved: <br />contains different conditions or is otherwise more stringent than <br />any effluent limitation in the Order; or <br />controls any pollutant limited in the Order. <br />The Order, as modified or reissued under this paragraph, shall also <br />contain any other requirements of the CWA then applicable. <br />12. The provisions of this Order are severable. If any provision of this <br />Order is found invalid, the remainder of this Order shall not be <br />affected. <br />13. By-pass (the intentional diversion of waste streams from any portion <br />of a treatment facility or collection system, except those portions <br />designed to meet variable effluent limits) is prohibited except under <br />the following conditions:
