( x)Exploration Project: 39-F1, New Stockton Courthouse <br /> ( )Survey Parcel: 149-020-120-00006 <br /> ( )Other APN: <br /> TEMPORARY ENTRY PERMIT <br /> Permission is given to the Judicial Council of California and Ninyo & Moore, hereinafter referred to as <br /> Consultant, and its officers, employees, agents, and contractors, to enter with all necessary equipment upon <br /> property owned by 110 E WEBER AVE LLC ("Permittor"), which is located at 110 E, Weber Ave., Stockton, <br /> California ("Court Property"). <br /> This permission for temporary entry ("Permit") is to allow the Judicial Council of California and the <br /> Consultant ingress and egress over and across the Permittor's Property at the locations shown on the illustration <br /> attached hereto and incorporated herein as Exhibit A (the "Access Route") to access the Permittor's Property for <br /> boring and drilling purposes to collect soil and groundwater samples to examine for possible contamination <br /> ("Work"). The Consultant will have a utility service explore for utilities prior to commencement of drilling. <br /> Consultant will use the Access Route to the area where drilling will take place. The Permit is subject to the <br /> following provisions: <br /> 1. Judicial Council of California and Consultant will exercise reasonable precautions to avoid damage <br /> and protect persons and Permittor's Property. <br /> 2. Consultant will not obstruct or interfere with any uses of the Permittor's Property. Consultant will <br /> clean and remove any material that may be discharged on the Permittor's Property while the <br /> Consultant is exercising its rights under this Permit. <br /> 3. It shall be the Consultant's responsibility to comply with all applicable federal, state and local laws, <br /> regulations, orders, rules, and requirements ("Applicable Requirements")in connection with its use of <br /> the Access Route as permitted under this Permit. All costs, expenses, liabilities, charges, and fines <br /> for non-compliance of any necessary permit(s)undertaken by Consultant shall be paid by Consultant. <br /> 4. Permittor assumes no liability for loss or damage to property or injuries to or deaths of agents, <br /> contractors, or employees of the Consultant by reason of the exercise of privileges given under this <br /> Permit. The Work shall be done at the Judicial Council of California's sole expense and Permittor <br /> shall not be responsible for any cost of the Work. <br /> 5. Judicial Council of California agrees to indemnify and hold harmless the Permittor from any damage <br /> caused by Consultant's activities authorized by this Permit. Judicial Council of California agrees to <br /> reimburse Permittor for any damage or destruction to the Permittor's Property, occurring by reason <br /> of the exercise of rights granted, or to replace or restore said Permittor's Property. <br /> 6. Permittor reserves the right to inspect the Permittor's Property after Consultant has completed its use <br /> of the Access Route and to require any restoration measures that the Permittor determines are <br /> necessary to restore the Permittor's Property to its condition prior to Consultant's use of the Access <br /> Route. <br /> 7. This Permit may be terminated at any time by the Permittor upon 3 days advance written notice; <br /> however, once the Consultant commences the Work, the Judicial Council of California may only <br /> terminate this Permit for good cause. <br /> 8_ For the purposes of this Permit, the Judicial Council of California's contact for notification and <br /> coordination of the Consultant's use of the Access Route and the Work is Jennifer Chappelle, <br /> 2860 Gateway Oaks Dr.,Suite 400,Sacramento,CA,95833,Telephone number 916-263-1945. <br /> I <br />
